`Pursuant to Article SIXTH of the Last Will and Testament of Fanny Doca (“Will”),
`Francine Doca LaSala (“Francine”), was nominated as the Executor. Francine qualified and was
`issued Letters Testamentary on October 6, 2016 and continues to serve as Executor.
`
`Pursuant to Article SECOND of the Will, Fanny Doca (“Decedent”) bequeathed “all of
`[her] jewelry and like articles ofpersonal adornment to [her] granddaughter, ALLISON LaSALA.”
`Pursuant to Article THIRD of the Will, the Decedent bequeathed “the remainder of [her] tangible
`personal property, including but not by way of limitation, all of [her] personal effects, any and all
`interest which [she] may have in furniture and household goods and any automobile or automobiles
`which [she] may own at the time of [her] death together with any policies of insurance in effect at
`[her] death which are applicable thereto including prepaid premiums thereon, to [her] daughter,
`FRANCINE DOCA LaSALA.”
`
`Pursuant to Article FOURTH (a) of the Will, the Decedent devised all of her right title and
`interest in and to the real property located at 304 Clinton Street, Brooklyn, New York 11201
`(“Property”) to the Decedent’s grandchildren: Frank Parisi (“Frank”), James La'Sala (“James”) and
`Allison LaSala (“Allison”), “in equal shares, share and share alike.” Pursuant to Article FOURTH
`(b) of the Will, the Decedent bequeathed all the rest, residue and remainder of her estate to her
`grandchildren, Frank, James, and Allison.
`
`The Property (the Estate’s most significant asset) is a residential building with four (4)
`rental apartments, three (3) of which are currently occupied by tenants. From July 1, 2016 through
`August 31, 2017, the Property accrued $182,925.00 in rental income.
`
`As set forth on Schedule A, the estate is also composed of a loan made to Frank by the
`decedent during her life. Francine, as Executor through her attorneys, has demanded repayment
`on that loan but Frank has not yet repaid and contests the validity of the loan.
`
`The Estate has incurred significant administration expenses, amounting to approximately
`$15,000 in attorney fees, as well as expenses associated with maintaining the Property, including:
`mortgage payments, utilities, repairs (wall repairs, ceiling repairs, painting, new doors, and
`sprinkler system repairs), routine maintenance, real estate taxes and insurance. Additionally, there
`are significant claims against the Estate, totaling approximately $300,000.00.
`
`There are presently two legal matters pending in Kings County Supreme Court against
`Francine Doca LaSala as Executor of the Will.
`In the first matter, Index No. 17341/2012
`commenced in 2012, Plaintiffs Holly Markson, Anthony LaSala, and Jenny LaSala seek recovery
`from Francine and the Decedent for contracting work and maintenance services allegedly
`completed on the Property by the Plaintiffs before the Decedent’s death for which they allegedly
`were not paid, as well as damages for alleged unjust enrichment. Upon information and belief, a
`note of issue was served in this matter and it is now set for trial. Plaintiffs claim damages in the

`action, as well as legal fees incurred by Francine in her capacity as Executor of the Will. The
`second matter, Index No. 508868/2017, concerns a partition proceeding instituted by Francine’s
`son Frank Parisi (also an interested party in this matter).
`In that proceeding, Frank seeks, inter
`alia, the sale of the Property and the distribution of the proceeds thereof. While Francine filed a
`motion to dismiss the complaint, the matter is pending, and the Estate bears the associated litigation
`costs incurred by Francine as Executor, including but not limited to attorney fees.
`
`Due to the significant costs associated with maintaining the Property, the administration
`expenses incurred by the Estate and possible liabilities resulting from the claims set forth in
`Schedule D, Francine had been collecting the rental income fiom the Property to pay for such
`expenses. Francine maintains that the Property cannot be distributed to the beneficiaries at this
`time in light of the significant claims against the estate set forth on Schedule D and the ongoing
`expenses to be incurred in connection with the administration of the estate.
