` The patent at issue in this proceeding is U.S. Patent No. 9,037,502 (“the ’502

`patent”). On February 3, 2015, arising from a petition brought by an unrelated
`
`party, an inter partes review (IPR) was instituted for U.S. Patent No. 7,548,875,
`
`the parent to the ’502 patent. (See Playboy Enters., Inc. et al. v. Skky, Inc.,
`
`IPR2014-01236, Paper 10.) On January 29, 2016, the PTAB issued a Final
`
`Decision finding all challenged claims unpatentable. (IPR2014-01236, Paper 45.)
`
`On June 7, 2017, the Federal Circuit affirmed the PTAB’s Final Decision. Skky,
`
`Inc. v. Mindgeek, S.A.R.L., Mindgeek USA, Inc., Playboy Enterprises, Inc., 2017
`
`U.S. App. LEXIS 10096, 2016-2018 (Fed. Cir. Jun. 7, 2017).
