`ORDER
`Authorizing Patent Owner’s Request to File Motion to Pursue Certificate of
`
`Correction on Patents Undergoing Inter Partes Review
`37 C.F.R. §42.20

`I This Order addresses issues common to the listed cases. Therefore, we
`exercise our discretion to issue one Order to be filed in each case. The
`parties are not authorized to use this style heading.

`L. BACKGROUND
`
`On December 4, 2025, Patent Owner requested the Board’s
`
`authorization for a motion (under 37 C.F.R. § 1.323) asking that the Board
`permit Patent Owner to petition the Director for a certificate of correction of
`each of the above-referenced patents presently undergoing inter partes
`review. See Ex. 3002 (email to Board dated December 4, 2025). Patent
`Owner, in its request, states that it plansto seek correction of the patents to
`add references to the names of parties to a joint research agreement. Id.
`(citing MPEP § 717.02(a)(Il)). Patent Owner also seeks authorization to
`move to seal and for a protective order concerning confidential documents
`that are alleged to support the anticipated § 1.323 motion. /d. Petitioner
`opposes Patent Owner’s requests but, if the Board allows the motions to be
`filed, asks that Petitioner be permitted to file a written opposition. /d.

`II. DISCUSSION
`
`We authorize Patent Owner’s filing of a motion for relief under 37
`C.F.R. §1.323, as well as the related motion(s) to seal and for a protective
`order. Petitionerisauthorizedto file oppositions to the motions and such
`oppositions will not exceed the permitted page length of the corresponding
`motions. No other reply briefing is authorized at this time.
`
`As it concerns the § 1.323 motion, we direct the parties’ attention to
`Honeywell Int’l Inc. v. Arkema Inc., 939 F.3d 1345, 1349-50 (Fed. Cir.
`2019), which explains the steps required by a patent owner seeking the
`Board’s leave to petition the Director for a certificate of correction for a
`
`patent undergoing post-grant proceedings before the Board. See Mylan

`The § 1.323 motion must not exceed ten (10) pages in length and is
`due no later than December23,2025. Petitioner’s opposition to that motion
`mustnot exceed ten (10) pages and is due no later than January 9, 2026.
`
`The motion(s) to seal and for a protective order and any opposition(s)
`from Petitionerare also due, respectively, no laterthan December 23, 2025,
`and January 9, 2026. Such motion(s)and opposition(s) are also each limited
`to ten (10) pages.?
`
`III. ORDER
`
`In consideration of the foregoing, it is:
`
`ORDERED that Patent Owner is authorized to file a motion
`requesting that the Board permit Patent Owner to petition the Director for a
`certificate of correction of the patents challenged in these proceedings,
`which motion must not exceed ten (10) pages and will be due no later than
`December 23, 2025;
`
`ORDERED that Patent Owner 1s authorized to move to seal certain
`exhibits Patent Owner intendsto submit in support of the aforementioned
`motion concering the certificate of correction, and is further authorized to
`move for entry of a protective order, and any such motion(s) to seal and for a
`
`protective order must not exceed ten (10) pages and will be due no later than
`
`December 23, 2025; and
`
`2 We encourage Patent Owner to combine the motion to seal and motion for
`a protective order in a single paper, if possible.
