`Plaintiff Maplebear Inc. dba Instacart (“Instacart”) and Defendants Cornershop

`Technologies, Inc., Cornershop Technologies LLC and Delivery Technologies US, Inc.

`(“Cornershop”) respectfully submit this consent for entry of a Stipulated Preliminary Injunction.
`

`
`Instacart filed its motion for preliminary injunction on July 16, 2020 (Docket No. 16) to
`
`preliminarily enjoin the use of certain images and other data as detailed in the motion and its
`
`complaint (Docket No. 1). Cornershop filed a Response in Opposition to Instacart’s motion on
`
`August 21, 2020 (Docket No. 29). Instacart filed a Reply on September 4, 2020 (Docket No. 40),
`
`and Cornershop filed a Sur-Reply on September 16, 2020 (Docket No. 47). Instacart also filed an
`
`Unopposed Motion for Hearing on the Preliminary Injunction Motion on September 4, 2020
`
`(Docket No. 41).
`

`
`To resolve Instacart’s motion in dispute, the parties have agreed to the form of the
`
`Stipulated Order attached hereto as Exhibit 1.
`

`Based on the foregoing, the parties jointly request this Court enter the Stipulated Order
`
`attached hereto as Exhibit 1.
