`STATE’S MOTION TO DENY BAIL FOR VIOLATION OF A

`COURT ORDER IN A FAMILY VIOLENCE CASE
`
`
`COMES NOW the State of Texas, by and through its Assistant District Attorney, and
`moves this Honorable Court to deny bail for BRYAN PEYTON RODGERS, hereinafter referred
`to as Defendant, who stands charged for Violation of Protective Order issued in a family
`violence case and in support thereof would show the following:
`
`Tex. Code Crim. Proc. Art. 17.152 permits a person who commits an offense

`under Penal Code Section 25.07 [Violation of Court Order], other than an offense related to a
`violation of a condition of bond set in a family violence case, may be taken into custody and,
`pending trial or other court proceedings, denied release on bail if following a hearing a judge or
`magistrate determines by a preponderance of the evidence that the person committed the offense.
`
`On or about May 14, 2020, Defendant was arrested for Violation of Court Order
`2.
`due to having contact with the Sonya Pace, the protected individual listed in the Order for
`Pretrial Supervision and Bond Conditions (hereafter referred to as the Order). On April 15,
`2020, in cause #167141 1, in the 230th District Court, Ham's County, Texas, the Court issued a
`the Order against Defendant, which remains in effect for the duration of the case, specifically
`prohibited from contacting Sonya Pace.
`

`Defendant is currently on bond for:
`
`Assault — Continuous Family Violence, cause #1671411, in the 230lh District Court, Harris
`County, Texas, with the Sonya Pace, listed as the Complainant.
`4.
`Defendant presents a danger to Sonya Pace, who is the protected individual in the
`Order and lives at the protected residence listed in the Order. The State requests that the Court
`deny bail as he is likely to commit family violence in the fiJture.
`
`WHEREFORE PREMISES CONSIDERED, the State of Texas prays that after a hearing,
`the Court will grant this Motion To Deny Bail for Defendant.
