`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.   A RESPONSE
`TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE
`MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
`
`ISSUE/MAILING DATE: 5/26/2018
`
`
`
`TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL
`REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application
`online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to
`Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address;
`and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b),
`2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of
`$125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations,
`TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without
`
`incurring this additional fee.
`
`The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to
`the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`SEARCH OF OFFICE’S DATABASE OF MARKS - PARTIAL
`
`The trademark examining attorney has only conducted a partial search of the Office’s database of registered and pending marks because
`virtually all of the wording in the circles is illegible.  TMEP §704.02; see 15 U.S.C. §1052(d).
`
`The applicant must submit a clear and legible drawing page depicting the mark clearly.  Afterward, the examining attorney will complete his
`search of the database of registered and pending marks.
`
`Informalities
`
`1.
`
`Amendment to the Description of the Mark Statement Required
`
`Applicant must submit an accurate and concise description of the literal and design elements in the mark.  37 C.F.R. §2.37; see TMEP §§808.01,
`808.02.  The applicant has submitted a description of the mark statement.  However, it is incomplete.
`
`The applicant must submit a new and complete description of the mark statement when it submits a new and legible drawing page with a clear
`
`

`
`

`
`

`

`

`depiction of the mark.
`
`2.
`
`Requirement for a Disclaimer - Incomplete
`
` A
`
` complete disclaimer is not possible until all of the wording in the mark is read.  The lack of clarity prevents that.
`
`Applicant must disclaim the descriptive wording “LIABILITY”, “BUSINESS”, and “FORENSIC ANALYTICAL” apart from the mark as
`shown.  See 15 U.S.C. §1056(a); TMEP §§1213, 1213.03(a).
`
`The term “LIABILITY” means “the sums of money which it owes.”   See the enclosed dictionary definition.  The term “LIABILITY” merely
`describes a feature of the services, namely, that they are to allow the prospective consumer to avoid having debts.
`
`The term “BUSINESS” means “work or some other activity that you do as part of your job.”   See the enclosed dictionary definition.  The term
`
`“BUSINESS” merely describes a feature of the services, namely, they involve activities of work.
`
`The term “FORENSIC” refers to “specializing in or having to do with the application of scientific.”   See the enclosed dictionary definition.
`
`The term “FORENSIC” merely describes a feature of the services, namely, that it has to do with the application of science.
`
`The term “ANALYTICAL” means “research involves using chemical analysis.”   See the enclosed dictionary definition.  The term
`
`“ANALYTICAL” merely describes a feature of the services, namely, that they use research in chemical analysis.
`
`A “disclaimer” is a statement that applicant does not claim exclusive rights to an unregistrable component of a mark.  TMEP §1213.  A
`disclaimer does not require removal of the element being disclaimed or otherwise affect the appearance of the applied-for mark.  See TMEP
`
`§1213.10.
`
`Applicant should submit the following standardized format for a disclaimer:
`
`No claim is made to the exclusive right to use “"LIABILITY", "BUSINESS", and "FORENSIC ANALYTICAL” apart from the
`mark as shown.
`
`TMEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493, 494 (Comm’r Pats. 1983).
`
`Only If Applicable - Examiner’s Amendment Recommended
`
`Examiner’s Amendments cannot be issued for partial amendments.  However, if all of the  outstanding issues can be resolved through an
`Examiner’s Amendment, the applicant is encouraged to respond to this Office Action by amending the application in a telephone call with the
`examining attorney to expedite the processing of the application.  Generally, only the submission of arguments to overcome a substantive refusal
`or an informal requirement, a requirement for the submission of specimens, a particular document or declaration, or the payment of a fee cannot
`be handled over the telephone.
`
`Questions Regarding This Office Action
`
`If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.  All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
`this Office action and will not extend the deadline for filing a proper response.  See 37 C.F.R. §§2.62(c), 2.191; TMEP §§304.01-.02, 709.04-
`.05.  Further, although the trademark examining attorney may provide additional explanation pertaining to the refusal(s) and/or requirement(s) in
`this Office action, the trademark examining attorney may not provide legal advice or statements about applicant’s rights.  See TMEP §§705.02,
`709.06.

`
`The USPTO applies the following legal authorities when processing a trademark and/or service mark application:

`
`Official USPTO letters and notices sent to applicants generally refer to one or more of these legal resources.  Both the Trademark Act and
`Trademark Rules of Practice can be viewed online at http://www.uspto.gov/trademarks/law/index.jsp.  The TMEP is
