`This Court recently accepted the transfer of the above-captioned cases because they are
`related to SACV 11-1860 DOC (JPRx). Plaintiff Preservation Technologies LLC alleges that the
`defendants in each of the above-captioned cases have infringed upon the same patents. Because there
`will be a significant amount of overlap between these cases, they are hereby ordered consolidated in the
`low case number, SACV 11-1860 DOC (JPRx). Plaintiff is hereby ORDERED to file a consolidated
`complaint by January 27, 2012. All future answers and motions shall be filed in the SACV 11-1860
`DOC (JPRx) docket.

`Pursuant to the America Invents Act, 35 U.S.C. § 299, “accused infringers may not be
`joined in one action as defendants or counterclaim defendants, or have their actions consolidated for
`trial, based solely on allegations that they each have infringed the patent or patents in suit.” Thus, the
`cases will be consolidated for pretrial purposes only at this point in time. Unless defendants waive their
`rights under the America Invents Act, see 35 U.S.C. § 299(c), or it is determined that “questions of fact

`common to all defendants or counterclaim defendants will arise in the action,” see 35 U.S.C. §
`299(a)(2), each defendant will be afforded its right to a separate trial. But, to maximize judicial
`efficiency, these cases are now consolidated for the purposes of pretrial coordination.
