`Plaintiff BlackBerry Limited has asserted U.S. Patent Nos. 8,676,929, 8,296,351,

`9,349,120, 9,021,059, 8,286,089, 8,572,182, and 8,825,777 against Defendant Twitter,
`

`
`Inc. in this action. See Docket No. 36. The Court has dismissed claims related to the
`

`
`’351, ’929, ’182, and ’777 patents, but claims related to the ’120, ’089, and ’059 patents
`
`5
`
`continue to be litigated in the case. See Docket No. 51 at 14 (dismissing claims related
`
`6
`
`to the ’351 and ’929 patents with prejudice, but permitting BlackBerry to amend its
`
`7
`
`complaint with respect to the ’182 and ’777 patent); see also Docket No. 53 (extending
`
`8
`
`deadline for BlackBerry to amend its complaint, if it chose to do so, to October 24,
`
`9
`
`2019, and extending deadline for Twitter to answer the remaining claims to November
`

`
`8, 2019). Under Rule 41(a)(1) of the Federal Rules of Civil Procedure, BlackBerry

`now respectfully submits this notice of voluntary dismissal without prejudice of those

`remaining claims in this action. Fed. R. Civ. P. 41(a)(1); Concha v. London, 62 F.3d

`1493, 1506 (9th Cir. 1995) (“The plaintiff may dismiss either some or all of the
