`In regard to Blaricum CD Company, the complaint concerns three sound recordings for which,
`as per agreement with Orchard/IODA, Orchard, not Blaricum CD Company, is responsible for
`payment and reporting of mechanical royalties;
`Second, the three recordings in question are not "pirate" or "bootleg" recordings as stated in
`the complaint, but rather were licensed by Blaricum CD Company from rights holders for
`various territories including the USA. (It should be noted that Nat King Cole —It's Only A Paper
`Moon is a broadcast recording, not the original studio recording.)
`
`For these reasons ---the sound recordings are not bootleg or pirate but rather licensed, and
`responsibility for mechanical rights reporting and payment belong to Orchard --- Blaricum CD
`Company should be removed as a defendant in this complaint.
