`NOTICE OF WITHDRAWAL OF MOTION TO COMPEL ARBITRATION
`TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD:
`PLEASE TAKE NOTICE that in light of Uber Technologies, Inc.’s (“Uber”) agreement
`to arbitrate Mr. Levandowski’s claims to specifically enforce Uber’s indemnity obligations (see
`ECF No. 43), Mr. Levandowski hereby withdraws his motion to compel arbitration (ECF No. 18).
`The hearing previously set for April 30, 2020 at 10:00 a.m., in Courtroom 19 of this Court is also
`withdrawn.
`Mr. Levandowski disagrees with the statements and allegations contained in Uber’s
`response to the motion to compel arbitration. Given that the parties have agreed on the
`appropriate forum for these claims, he will proceed with his claims against Uber in arbitration as
`agreed to by the parties and will respond to Uber’s allegations in the arbitration proceeding.
