`respectfully submit this Further Joint Case Management Statement in accordance with the Court’s
`November 1, 2024, Revised Case Management and Scheduling Order (ECF No. 192), the Standing
`Order for All Judges of the Northern District of California, and Civil Local Rule 16-10(d).
`CHANGES SINCE THE LAST CASE MANAGEMENT CONFERENCE
`I.
`The last case management conference was held on October 31, 2024. Following that
`conference, on November 1, 2024, the Court revised the case schedule, including setting key
`deadlines, including a trial date on April 27, 2026. (ECF No. 192.)
`On January 16, 2025, the Court granted Defendants Scott Powell, Carly Sanchez, and Kleber
`Santos’s Motion to Dismiss. (ECF No. 198.)
`On February 6, 2025, the Parties filed a Joint Case Management Statement and Rule 26(f)
`Report. (ECF No. 204.)
`The Director Defendants filed their answers on March 10, 2025. (ECF Nos. 215 and 216.)
`In addition, since January, the Parties have filed, and the Court has entered, three stipulated
`orders regarding discovery (ECF Nos. 210, 214, 219), filed one joint discovery brief (see infra § II),
`and engaged in discovery (see infra § VI).
`PENDING MOTIONS
`II.
`On March 26, 2025, the Plaintiffs and Wells Fargo filed a joint discovery brief with Judge
`Kim, regarding (1) the appropriate number of document custodians, and (2) the time period for
`discovery relating to Plaintiffs’ “lending claims.” (ECF No. 217.) Those issues are set to be heard

`discovery disputes, which Plaintiffs anticipate may require court involvement to resolve.
`III. AMENDMENT OF PLEADINGS
`On September 20, 2024, the Court issued its Order Granting-in-Part and Denying-in-Part
`Defendants’ Motions to Dismiss. (ECF No. 176.) On October 3, 2024, Co-Lead Plaintiffs filed their
`Second Amended Complaint. (ECF No. 177.) On January 16, 2025, this Court granted Defendants
`Scott Powell, Carly Sanchez, and Kleber Santos’s Motion to Dismiss. (ECF No. 198.) On March 10,
`2025, the Director Defendants answered Plaintiffs’ Second Amended Complaint. (ECF Nos. 215,
`216.) The deadline to amend pleadings has passed. (See ECF No. 192.)
`EVIDENCE PRESERVATION
`IV.
`The Parties have reviewed the Northern District of California Guidelines Relating to the
`Discovery of ESI and confirm that they have taken reasonable and proportionate steps to preserve
`evidence relevant to the Action consistent with the Guidelines. See Stipulation and Order Re: ESI,
`entered March 10, 2025 (ECF No. 214).
`DISCLOSURES

`On January 23, 2025, the Parties conducted their Rule 26(f) conference. (See ECF No. 204.)
`Plaintiffs served their Fed. R. Civ. P. 26 Initial Disclosures on February 6, 2025. Defendants served
`their Fed. R. Civ. P. 26 Initial Disclosures on February 13, 2025.
`VI. DISCOVERY
`The Court referred this Action to Magistrate Judge Sallie Kim for discovery on February 12,
`2025. (ECF No. 208.) Accordingly, the Parties will bring any discovery disputes directly to
`Magistrate Judge Kim for resolution.
`Discovery Taken to Date
`A.

`Plaintiffs’ Position
`
`On January 24, 2025, Plaintiffs served their First Set of Document Requests (“Plaintiffs’ First
`Document Requests”) to Defendants and Nominal Defendant. Defendants served their responses and
`objections to Plaintiffs’ First Document Requests on February 29, 2025. Since that time, the Parties
`have met and conferred regarding Plaintiffs’ First Document Requests. In the last several weeks,

`Wells Fargo re-produced to Plaintiffs thousands of documents previously produced in two litigations
`pending against the Company, In re Wells Fargo Mortgage Discrimination Litig., No. 3:22-cv-00990-
`JD (N.D. Cal.) and SEB Inv. Mgmt. AB v. Wells Fargo & Co., No. 3:22-cv-03811-TLT (N.D. Cal.).
`However, in response to Plaintiffs’ First Document Requests, neither Wells Fargo nor any other
`Defendant has produced (and Plaintiffs have yet to receive) documents collected specifically for this
`litigation. For example, in response to Plaintiffs’ First Document Requests, Plaintiffs have not
`received Board of Directors-level documents or documents produced by any of the Individual
`Defendants specifically for this case. Defendants have reassured Plaintiffs that these case-specific
`productions will be forthcoming.
`On January 31, 2024, Plaintiffs served their Notice of Fed. R. Civ. P. 30(b)(6) Videotaped
`Deposition of Defendant Wells Fargo (“30(b)(6) Notice”). The 30(b)(6) Notice covers a variety of
`relevant topics concerning Plaintiffs’ claims, Defendants’ document collection efforts, and available
`insurance coverage. Wells Fargo objected to the 30(b)(6) Notice but has confirmed—subject to the
`Parties’ agreement on the number of Rule 30(b)(1) and Rule 30(b)(6) depositions—that Wells Fargo
`will provide deposition dates for certain Rule 30(b)(6) topics by April 18, 2025, and make witness(es)
`available by May 23, 2025. The Parties have agreed to finish meeting and conferring about the
`remaining 30(b)(6) topics by June 30, 2025.
`2.
`Defendants’ Position
`
`The Parties are currently negotiating the scope of additional discovery. Wells Fargo will make
`rolling productions of documents that are identified using search parameters that are either agreed-
`upon by the Parties, or ordered by the Court. The Director Defendants served Responses and
`Objections to Lead Plaintiffs’ First Set of Document Requests on February 28, 2025. Plaintiffs have
`not yet reached out to meet and confer with the Director Defendants regarding their Responses and
`Objections.
`Scope of Anticipated Discovery
`B.
`The Parties anticipate that the scope of discovery will include requests for the production of
`documents, non-party document subpoenas, interrogatories, requests for admission, and depositions
`concerning facts relevant to the legal issues.

`C. Modifications on Limits to Discovery
`1.
`Plaintiffs’ Position
`
`Plaintiffs believe that the complexity of the facts underlying their claims and the number of
`potential key witnesses (including sixteen Individual Defendants, other key Wells Fargo employees,
`and certain non-parties and their representatives) warrants departing from the limitation on
`depositions prescribed by Fed. Rule Civ. P. 30. Because document productions only recently
`commenced, Plaintiffs are not yet in a position to determine how many additional depositions may
`be needed, but have proposed taking thirty-five (35) fact depositions.
`Plaintiffs also believe the complexity of the facts underlying their claims warrant departing
`from the limitation of twenty-five interrogatories provided by Fed. R. Civ. P 33. Given the recent
`production of documents, and ongoing discussions, Plaintiffs are not yet able to determine how many
`additional interrogatories may be needed and intend to confer with Defendants on this topic.
`2.
`Defendants’ Position
`The Parties are actively engaged in discussions regarding potential modifications to the limits
`on fact discovery set forth in the Federal Rules of Civil Procedure. If the Parties are unable to reach
`agreement concerning any proposed modifications, they will file a joint letter pursuant to Magistrate
`Judge Kim’s Standing Order.
`Fact Discovery Cut-Off and Substantial Completion
`D.
`The cut-off for fact discovery is August 1, 2025. (ECF No. 192 at 1.) After meeting and
`conferring, the Parties agreed that a substantial completion deadline for the production of documents
`is appropriate, but require resolution on the pending discovery motion (ECF No. 217) in order to
`finalize this date.
`Protective Order

`The Court approved the Parties’ Stipulated Protective Order on March 3, 2025. (ECF
`No. 210.)

`The Court approved the Parties’ Stipulated ESI Order on March 10, 2025. (ECF No. 214.)

`VII. OTHER MATTERS
`Plaintiffs are working to move discovery forward as quickly as possible. For example,
`Plaintiffs served discovery requests the day after the Rule 26(f) conference and served their Fed. R.
`Civ P. 30(b)(6) Notice on Wells Fargo one week later. Plaintiffs served search terms for ESI-related
`documents a few weeks later. Despite moving as quicky as the Federal Rules allow, the fact discovery
`cut-off of August 1, 2025 for this complex case is fast approaching. As such, Plaintiffs request that
`the Court set another case management conference prior to the August 1, 2025 deadline, to allow the
`Parties to provide a further update on the status on discovery.
