`Pursuant to Northern District of California Civil Local Rules 6-3 and 7-11, Plaintiff Yahoo! Inc.
`
`(“Yahoo”) hereby moves the Court to continue the Initial Case Management Conference currently set for
`
`April 20, 2016. Yahoo filed a complaint against Kudelski SA and OpenTV, Inc. (“Defendants”) seeking
`
`declaratory judgment of patent non-infringement and invalidity on January 21, 2016. Dkt. No. 1. On
`
`that same day, an Initial Case Management Conference was set for April 20, 2016, and the case was
`
`referred to Magistrate Judge Cousins. Dkt. No. 11. Defendants returned waivers of service of summons
`
`on February 11, 2016. Dkt. Nos. 15 & 16. The deadline to file responsive pleadings is April 11, 2016.
`
`Id. The deadline to file the Joint Case Management Statement is currently April 13, 2016. Dkt. No. 11.
`
`While Yahoo has consented to have Judge Cousins conduct all further proceedings in this case, Dkt. No.
`
`14, counsel for Defendants have not yet appeared and so have not indicated whether or not they consent.
`
`Further, in light of the deadline for responsive pleadings, the parties have not had the opportunity to
`
`conduct a Rule 26(f) conference. The schedule has not previously been modified in this case, and no
`
`deadlines have been set beyond the Initial Case Management Conference. In light of the foregoing,
`
`Yahoo requests that the Initial Case Management Conference be continued until such time as counsel for
`
`Defendants appear and file a responsive pleading, and the parties have adequate time to conduct a Rule
`
`26(f) conference. Counsel for Defendants do not oppose this request. Miller Decl. ¶ 2.
