`Pursuant to Local Civil Rules 6-2 and 7-12, Plaintiff 10Tales, Inc. (“10Tales”) and
`Defendants TikTok Inc., TikTok Pte. Ltd., ByteDance Ltd., and ByteDance Inc. (collectively,
`“Defendants”) through their counsel of record, hereby stipulate as follows:
`WHEREAS the close of claim construction discovery was on April 27, 2022 (ECF Nos.
`129 and 157);
`WHEREAS the parties previously filed a joint stipulation on April 13, 2022, modifying the
`case schedule to accommodate the respective schedules and availability of the parties’ expert
`witnesses (ECF No. 150);
`WHEREAS the Court granted the parties’ joint stipulation on April 19, 2022 (ECF No.
`
`151);
`
`WHEREAS the Defendants filed a Motion to Compel Compliant Damages Contentions on
`April 26, 2022 (ECF No. 153);
`WHEREAS the Court denied without prejudice Defendants’ Motion to Dismiss on April
`28, 2022 (ECF No. 156);
`WHEREAS the Court entered its Case Management and Scheduling Order on April 28,
`2022 (ECF No. 157);
`WHEREAS Defendants’ expert witness Dr. Alan Bovik is no longer available for
`deposition on May 4, 2022, due to Judge Gilstrap unexpectedly rescheduling the United Services
`Automobile Association v. PNC Bank, N.A., C.A. No. 2:20-cv-00319-JRG (E.D. Tex.) matter for
`trial on May 9, 2022, his commitment to prepare for said trial, and other prior commitments;
`WHEREAS 10Tales’ Opposition to Defendants’ Motion to Compel Compliant Damages
`Contentions is due on May 10, 2022;
`WHEREAS the parties wish to maintain a standstill of discovery and contentions until the
`Court issues its Markman order;
`THEREFORE, the parties hereby stipulate and agree to the following:
`The deposition of Dr. Alan Bovik shall occur on May 19, 2022, assuming no further
`changes to the USAA v. PNC trial schedule.
`10Tales’ Opening Claim Construction Brief shall be due on May 27, 2022;

`Defendants’ Responsive Claim Construction Brief shall be due on June 10, 2022;
`10Tales’ Reply Claim Construction Brief shall be due on June 17, 2022;
`The technology tutorial will be held on June 22, 2022, at 2:00 pm; and
`The claim construction hearing will be held on July 13, 2022, at 2:30 pm.
`The parties agree to a stay of discovery, contentions, and any potential motions to strike or
`compel said contentions, until the Court issues its Markman order; and
`Defendants will submit papers per Local Civil Rule 7-7(e) by May 6, 2022, withdrawing
`their pending Motion to Compel Compliant Damages Contentions without prejudice with leave to
`refile after the Court issues its Markman order.
