`
` A. Yes.
`
` Q. When you -- strike that.
`
` The morning of this incident, the Thursday morning
`
`when you showed up, did you know that your brother was going
`
`to be weedeating 10 or 12 feet from that highway?
`
` A. No, no, and it wasn't even much that he did as far
`
`as weedeating there.
`
` Q. Who told your brother to go work where he was
`
`working at the time of his death?
`
` A. No, no one. He did it on his own.
`
` Q. How did he get the weedeater?
`
` A. Well, because he saw it there and he went and got
`
`it.
`
` Q. Where did he see it?
`
` A. Well, there where it was in the garage.
`
` Q. And when you showed up on the morning of the
`
`incident what time did you show up to work?
`
` A. Around 8 or 9 is when we arrived on that day.
`
` Q. What time was your brother struck and killed by that
`
`truck?
`
` A. I don't remember what time it was. It was around
`
`12:00, 12:30 something like that. I don't remember.
`
` Q. I've got 1317. So what's that 1:20? Does that
`
`sound right?
`
` A. I don't remember, but it was around midday.

`
`A. That's not showing up very well.
`
`Q. No, it's not.
`
`A. Maybe try the other one.
`
`Q. Yeah. Go ahead.
`
`A. It's about the same.
`
`Q. Okay. And then do you see any indications of
`
`the tire mark that you've identified as No. 2 on that
`
`Exhibit 3?
`
`A. Yes.
`
`Q. And, again, will you circle those for us.
`
`A. (Witness complies.)
`
`Q. Will you put a 2 within the circle that you just
`
`made and a 1 in the other one, somewhere where we can see
`
`it.
`
`A. (Witness complies.)
`
`Q. Yeah. Great. Maybe go over that 2 again just
`
`to see if it gets a little darker for us.
`
` All right. Great.
`
` Am I correct from what you've just shown us and
`
`from your diagram that, at least from your investigation,
`
`you determined that the truck drove through those palm
`
`fronds that we see on Exhibit 3?
`
`A. Yes. And how we document that is -- why that
`
`wasn't in the report is because anything that's a

`
`damage-causing event we would make note of. So if it
`
`just brushes through some brush, we are not going to make
`
`that an area of impact because there's no damage-causing
`
`event to either the brush or the vehicle involved.
`
`Q. Okay. All right.
`
` That answers my question regarding Exhibit 4.
`
`A. I went on a little bit. Yes.
`
`Q. That's great.
`
` Do you recognize what we see in Exhibit 5?
`
`A. Yes.
`
`Q. And describe that for us if you will.
`
`A. That is the area where the vehicle traveled
`
`through, which would be just north, about where the
`
`tire -- tire mark end and where the vehicle struck the
`
`pole, where we believe the ped was standing and where the
`
`truck also struck the fence.
`
` And where I'm standing there in the picture --
`
`or Sergeant Pederson, just immediately south of that
`
`olive tree that is in front of us there is where the
`
`victim was laying when I came on the scene.
`
`Q. Okay. Who took these photographs, by the way?
`
`A. Officer Scheer.
`
`Q. And did Officer Scheer take the photographs
`
`after consulting with you about what you wanted

`
`A. Typically, we won't talk about what we want to
`
`document. We, as officers, understand that we've all
`
`been trained. So I would just ask him to take the
`
`photos. And at that point, he's just like me. When I
`
`say that, that he is just starting at the beginning of
`
`the scene and seeing anything that stands out to him, and
`
`that's what he would take photos of.
`
`Q. All right. And then Exhibit 6, which we've
`
`already looked at. But, again, is this just a closer
`
`picture of what we see in Exhibit 5 showing the broken
`
`pole and fence?
`
`A. A little further south, yes.
`
`Q. As you look at Exhibit 6, do you see any signs
`
`or any indications of any tire marks?
`
`A. You know, it's difficult to tell. I don't
`
`remember seeing with the naked eye if it was in fact a
`
`mark, but it appears that there's kind of a trail just
`
`east of the fence that starts east -- easterly south of
`
`it.
`
`Q. Well, and, again, looking at the photos, do you
`
`recall from your investigation seeing tire marks along
`
`the fence line south of the pole?
`
`A. No.
`
`Q. And I'm going to show you Exhibit 7.
`
` Do you see anything there -- does that in any

`

`
`A. I'm sorry. Can you say the question one more
`
`time?
`
`Q. You bet.
`
` You refer to the injuries sustained by the
`
`parties involved and -- as helping to form -- helping you
`
`to formulate your opinions as reflected in your summary.
`
`A. Yes.
`
`Q. And my question is: Was there anything about
`
`the injuries -- or do you recall anything in particular
`
`about the injuries sustained by Carlos Gonzales that
`
`helped you come to your opinions as reflected in your
`
`summary?
`
`A. Well, based on the statements that I received
`
`and based on what I saw of him, it was consistent with
`
`what I wrote in the summary.
`
` I'm not sure if I'm understanding your question
`
`totally correctly.
`
`Q. And I guess what I'm -- well, certainly, would
`
`part of the aspect of his injuries be the fact that he
`
`died as a result of this accident?

`
`
`
`·1· · · ·Q· · Okay.· Now, what information did you have
`
`·2· ·regarding the amount of support that Mr. Gonzalez was
`
`·3· ·providing to his family before his death?
`
`·4· · · ·A· · I don't believe that I had any such
`
`·5· ·information.
`
`·6· · · ·Q· · All right.· So how did you -- I mean, how do
`
`·7· ·you know that this number you've come up with would be
`
`·8· ·the support he actually would provide to his family?
`
`·9· · · ·A· · No one would -- that's an unknowable.· There's
`
`10· ·no way to know the answer to that question.· Because
`
`11· ·Mr. Gonzalez is deceased in the universe that we live
`
`12· ·in, and there's no way to travel to another alternative
`
`13· ·universe where he didn't and try to measure that.
`
`14· · · ·Q· · Well, how did you -- well, I mean what's the
`
`15· ·basis for your earning capacity number if -- since we
`
`16· ·don't know, we can't possibly know, then what's the
`
`17· ·basis for your earning capacity number?
`

`

`
`21· · · ·A· · But earning capacity, again, we go back to the

`
`24· ·they're of prime working age and don't have a
`

`
`
`
`·1· · · ·Q· · Okay.· And that's what I wanted to confirm,
`
`·2· ·because that was my understanding, is your opinions in
`
`·3· ·this case as reflected in your report is that this is
`
`·4· ·the amount of money that would have been available to
`
`·5· ·provide support, correct?
`
`·6· · · ·A· · Based on statistics, yes.
`
`·7· · · ·Q· · Okay.· But I don't see anything in your

`

`
`13· · · ·Q· · Well, how is his -- how are your opinions

`
`15· · · ·A· · My opinions regarding his earning capacity are

`
