`to be weedeating 10 or 12 feet from that highway?

` A. No, no, and it wasn't even much that he did as far

`working at the time of his death?

` A. No, no one. He did it on his own.

` Q. How did he get the weedeater?

` A. Well, because he saw it there and he went and got

`it.

`just brushes through some brush, we are not going to make
`
`that an area of impact because there's no damage-causing
`
`event to either the brush or the vehicle involved.

`Q. Okay. All right.

` That answers my question regarding Exhibit 4.

`A. I went on a little bit. Yes.
`
`Q. That's great.
`
` Do you recognize what we see in Exhibit 5?
`
`A. Yes.
`
`Q. And describe that for us if you will.
`
`A. That is the area where the vehicle traveled
`
`through, which would be just north, about where the
`
`tire -- tire mark end and where the vehicle struck the
`
`pole, where we believe the ped was standing and where the
`
`truck also struck the fence.
`
` And where I'm standing there in the picture --
`
`or Sergeant Pederson, just immediately south of that
`
`olive tree that is in front of us there is where the
`
`victim was laying when I came on the scene.
`
`Q. Okay. Who took these photographs, by the way?
`
`A. Officer Scheer.
`
`Q. And did Officer Scheer take the photographs
`
`after consulting with you about what you wanted
`
`documented as part of your investigation?

`A. Typically, we won't talk about what we want to

`document. We, as officers, understand that we've all
`
`been trained. So I would just ask him to take the
`
`photos. And at that point, he's just like me. When I
`
`say that, that he is just starting at the beginning of
`
`the scene and seeing anything that stands out to him, and
`
`that's what he would take photos of.
`
`Q. All right. And then Exhibit 6, which we've
`
`already looked at. But, again, is this just a closer
`
`picture of what we see in Exhibit 5 showing the broken
`
`pole and fence?
`
`A. A little further south, yes.
`
`Q. As you look at Exhibit 6, do you see any signs
`
`or any indications of any tire marks?
`
`A. You know, it's difficult to tell. I don't
`
`remember seeing with the naked eye if it was in fact a
`
`mark, but it appears that there's kind of a trail just
`
`east of the fence that starts east -- easterly south of
`
`it.
`
`Q. Well, and, again, looking at the photos, do you
`
`recall from your investigation seeing tire marks along
`
`the fence line south of the pole?
`
`A. No.
`
`Q. And I'm going to show you Exhibit 7.
