`MANDATORY SETTLEMENT CONFERENCES – UNLAWFUL DETAINER CASES
`SUPERIOR COURT OF CALIFORNIA, COUNTY OF KERN

`ATTENTION: To all parties and counsel to residential unlawful detainer actions filed in the Metropolitan Division of the
`Superior Court, County of Kern – Beginning January 14, 2019, the Metropolitan Division of the Superior Court, County
`of Kern only, has implemented a Shriver pilot project for Mandatory Settlement Conferences in all residential unlawful
`detainer cases set for trial in the Metropolitan Division.
`
`The Shriver Mandatory Settlement Conferences (Shriver MSC) are conducted under California Rules of Court, Rule
`3.1380 and through a Shriver grant (B&P C. §6159.5; Gov. C. §§68085.1, 68650 et seq. 70626). Note: In a Shriver MSC,
`settlement conference statements are not required. There is no provision for confidentiality of communication, except as
`provided in Evidence C. §1152(a).
`
`NOTICE of the date and time of the Shriver MSC will be sent upon the filing of an Answer by any Defendant.
`
`SHRIVER MSC will be held before trial in the Landlord Tenant Assistance Center, located at the Metropolitan Division
`Courthouse, 1415 Truxtun Avenue, Basement, Bakersfield, CA, and will be conducted by the court’s Settlement Master.
`
`In all residential unlawful detainer actions filed in the Metropolitan Division of the Superior Court, County of Kern the
`parties and their attorneys (if they have one), and principals with full and unlimited authority to settle must meet with the
`Settlement Master to discuss possible settlement of the case. The Settlement Master does not make a decision in the case
`but assists the parties in evaluating the strengths and weaknesses of the case and assists in negotiating a settlement or
`narrowing issues for trial. Trial counsel, parties and persons with full authority to settle without limit must personally
`attend the Shriver MSC and must be genuine with their full authority to settle. Witnesses are not needed at the Settlement
`Conference.
`
`Your Shriver Mandatory Settlement Conference is a time to settle your case. Be ready to talk seriously about how to
`solve your case. Be prepared to talk about settlement. If you cannot settle, there will be discussion of narrowing of
`issues, or stipulating to facts, or agreeing to a case management plan.
`
`Resolving Unlawful Detainer (Eviction) Cases video at http://www.courts.ca.gov/20130.htm must be viewed before the
`Settlement Conference.
`
`Sanctions may be imposed pursuant to CRC Rule 2.30, CCP §§128.5-128.7, 177.5, 575.2.
`
`If settlement is reached at or before the MSC, the parties may privately execute a written settlement agreement and/or
`stipulated judgment. In either case, the parties may stipulate that the Court shall retain jurisdiction over them to enforce
`the settlement as long as the parties comply with Code of Civil Procedure §664.6. If the case fully settles before the MSC,
`then plaintiff or party seeking affirmative relief must file the Notice of Settlement (form CM-200) immediately. Do not
`appear at the MSC. Upon filing of the Notice of Settlement, the clerk will set the matter for an Order to Show Cause re:
`Dismissal 45 days from the date of filing of the Notice of Settlement. If the terms of settlement are met, Plaintiff is to file
`a Request for Dismissal, vacating the OSC (C.R.C. Rule 3.1385).
`
