`WHEREFORE,on March 23, 2021 the Court granted Nextpulse’s motion to appoint a
`
`discovery referee and orderedthe parties to prepare a stipulation and proposed order including
`
`specific procedures for recommendations, objections, and responses.
`
`WHEREFORE Brunswick continuesto object to the use of a discovery referee but enters
`
`this stipulation for the sole purpose of complying with the Court’s March 23, 2021 Order.
`
`WHEREFORE,theparties agree that Hon. Elizabeth D. Laporte (Ret.) of JAMS, Two
`
`Embarcadero Center, Suite 1500, San Francisco, CA 94111, Telephone: 415-774-2611, SBN:
`
`106670 will serve as discovery referee. Judge Laporte’s hourly rate is $800 per hour.
`
`WHEREFORE,thereferee shall file with the court a report that includes a
`
`recommendation on the merits of any disputed issue, a statementof the total hours spent and the
`
`total fees charged bythe referee, and the referee’s recommendedallocation of payment. The
`
`referee shall serve the report on all parties. Any party mayfile an objection to the referee’s report
`
`or recommendations within 10 days after the referee serves andfiles the report. The objection shall
`
`be served on the referee andall other parties. Responses to the objections shall befiled with the
`
`court and served on the referee and all other parties within 10 days after the objection is served.
`
`The court shall review any objectionsto the report and any responses submitted to those objections
`
`and shall thereafter enter appropriate orders. Nothingin this section is intended to deprive the
`
`court of its power to changethe termsofthe referee’s appointment or to modify or disregard the
`
`referee’s recommendations, and this overriding power maybe exercised at anytime,either on the
`
`motion of any party for good cause shown oron the court’s own motion.
`
`IT IS HEREBY STIPULATEDbyand betweenthe Parties by and through their respective
`
`attorneys of records, that Hon. Elizabeth Laporte (Ret.) will serve as discoveryreferee for the
