`located at 2154 Leavenworth Street in San Francisco, California, and to common area appurtenant

`to the Unit under the following Department of Building Inspection DBI permits,

`202102124580, 202201125863, 202203049222, and 202303022935, and other permits that may

`be properly applied for relating to the Unit

`Permits . The Unit is one of four condominium

`units in the building located at 2150-2156 Leavenworth

`I have personal knowledge of the facts set forth below and could and would

`competently testify thereto if called upon to do so.

`Hive Builds, Inc. and its subcontractors have performed our work in substantial
`
`compliance with the plans and calculations that have been submitted to DBI as part of the
`
`submittals for the Permits.
`

`see that the exposed framing (no walls closed), unfinished floors, and unfinished ceiling. Further,

`the as the Unit is located on the fourth level of the Building, there would be no way to see the

`work being done inside the .. foundation,

`anywhere within the Unit where access was not provided.

`On February 16, 2023, I was present for an on-site inspection by DBI Senior
`
`Building Inspector Joe Ng of the Work and alleged damage to portions of the Building, including
`
`Unit 2152. Mr. Viani and Mr. Kearney were present as well, and they pointed out cosmetic cracks
`
`in Unit 2150 and Unit 2152. Attached hereto as Exhibit B is a correspondence from Senior
`
`Building Inspector Ng to Mr. Viani, other interested parties, and me, in which Senior Building
`
`Inspector Ng stated, in pertinent part:
`
`Site investigation include interior of lower floor units #2152 & #2150, visual
`
`inspection only found minor cosmetic cracks from the units ceiling and walls.
`
`These minor damages does not seem warrant the cause to the claimed structural
`
`damage. However, it might caused by the vibration during the demolition work
`
`and/or water leak (exposed to weather) during removal of (E) roof for new roof
`
`construction of Unit # 2154.
`
`Mr. Kearney had an additional opportunity to
`
`drywall was not yet installed as February 16, 2023, and the framing o

`Shane Kitchen, my colleague at Hive Builds, Inc., and I have diligently responded

`to and addressed each instance of alleged property damage identified in Exhibit 5 of the
`
`Declaration of

`acting manager Valerie Kirk, which exhibit is attached hereto as
`
`Exhibit C. The subject issues outlined in the Kirk declaration have been the inadvertent result
`
`of
`
`that, unfortunately, can occasionally impact neighboring units
`
`and common areas of older, multi-level, and multi-unit buildings like the subject Building. As
`

`of the various subcontractors hired to do discrete tasks
`
`on this project, we ultimately take responsibility for the quality of all construction work
`
`performed on our projects. On this particular project, we have done everything possible to
`
`minimize inconvenience and disruption to
`
`activities-related issues outlined in the Kirk declaration should in any way be deemed to be the
`
`result of errors or omissions by our clients, Will and Tracy Sevush, who at all times have
`
`authorized and directed our firm to minimize any disruption or inconvenience to their neighbors
`
`in the Building and to immediately address and appropriately fix any problems which may have
`
`been caused by our construction activities in and around the Building.
`

`There are no active notices of violations issued by the DBI that requires work to
`
`stop or indicates that the Work is being performed outside the scope of any of the Permits. A
`
`copy of the Permit Details Report for the DBI Permit # 202303022935, which was obtained to
`
`comply with the last Notice of Violation #202303547, is attached here as Exhibit D.
`

`Based on my knowledge about the project and background, experience and
`
`qualifications, it is my opinion that none of the construction work performed in this project has
`
`adversely impacted the structural integrity of the Building.
`

`return to their residence.

`On December 1, 2022, you provided me with photos, approved calculations and
`plans for the addition of a new deck on the roof of the 3 story house with 2 levels of
`flats and a soft story garage on level 1. You were concerned the addition of the roof
`deck could overload the structure. In addition, the photos provided indicate they will
`be adding 1.5" of light weight concrete/hardwood flooring to the second level floor
`over the existing floor.
`
`The calculations prepared by L Wong Engineering dated December 1, 2021 were
`reviewed and contained a description and calculations for a deck of approximately
`480 square feet (SF) set on the roof. The calculations indicated new 32’-9” trusses
`would be installed to directly support the deck and roof which would be in turn
`supported by the exterior walls. Thus, no interior columns are needed. Further, the
`calculations do not address the added weight of the lightweight concrete on the third
`floor unit that will be in addition to the existing floor dead load. It is believed the
`interior of 2154 was gutted and the lightweight concrete was placed over the
`existing sub floor and radiant board.
`
`We reviewed the calculations and drawings and offer the following comments:
`
`1. The Wong calculations provide values for the roof loads, 15 pounds per
`square foot (psf ) Dead load (DL) and 20 psf Live load (LL) and the deck
`loads of 25 psf DL and 60 psf LL are additive in the 480 SF of the deck.
`2. There was no information presented to evaluate the extra load on the
`structure’s perimeter walls and building’s foundations. The additional load
`from the deck could be 21,500 lbs. transferred to the perimeter walls. The
`additional foundation load from this weight adds approximately 430 lbs. per
`linear foot (LF) to the walls and foundations of the unit.
`

`3. There is no information showing this additional 430 lbs. per LF can be
`accommodated by the walls, foundation or soils or that the existing lateral
`bracing, which was exposed on the upper level, is adequate.
`4. On photo 5605 (attached) it appears new walls were constructed, however, it
`is not known if these are bearing walls or partition walls. If they are partition
`walls, the upper floor loads would be carried by the perimeter foundations. If
`they are bearing, then the loads would be transferred to the floor joists in this
`unit which would be the ceiling joists on level 2 and cause cracking to the
`plaster ceiling on level 2.
`
`
`The calculations do not address the added load from the lightweight concrete to
`2154, which is typically 13 psf, for a total weight of nearly 15,000 lbs. This equates
`to an additional foundation load of 250 lbs. per LF. Thus much of the foundation
`will have an additional 680 lbs. per LF. This is a serious amount of weight and no
`calculations were provided for the additional load. This added weight will affect the
`walls, foundations and may exceed the capacity of the soil to sustain the load, as no
`soils information was obtained.
`
`We recommend L Wong Engineering be asked to provide information showing the
`deck and additional lightweight concrete loads will not cause any damage to the
`existing structure’s walls and are properly braced for lateral loads resulting from the
`new deck. This review must be completed prior to use of the deck and remodeled
`space. In addition, they should provide a statement and show the new interior walls
`do not imposed new point loads on the floor/ceiling and will not cause the ceiling to
`deflect resulting in plaster cracking of the level 2 ceilings.
`
`It is our opinion this is a serious oversight that may cause damage to your client.
`

` Thank you for your phone call this morning regard to your compliant follow-up. PTS shown
`project sponsor filed an addition permit on 3/2/2023 to address the NOV # 202303547 issued on
`2/17/2023. The new permit review had been held up at the City Planning station but released today. I
`believe they will be moving forward to the BLDG/PAD Stations very soon and quickly. As previous
`email stated, you can reach out to Jimmy Cheung (OTC Manger @ 628.652.4833) or Willy Yau (PRS
`Manager @ 628.652.3754) during the PRS plan review stage for the revision permit and bring up to
`their attention for a second look about your concern pertaining to the structural design of the original
`approved permit under PA# 2021.0212.4580. Otherwise, you still can appeal the permit approval after
`it issuance.
`
`Given the following information share with DBI Plan Review Engineers:

` Mr. Steven Viani, license professional engineer representing the complainant side, HOA for
`the condominium building at 2150 - 2154 Leavenworth
` Per Mr. Viani, addition of roof deck and hydronic heating system throughout top floor unit
`adding dead load to the existing building bearing walls and foundation along with the removal
`of interior bearing wall within Unit #2154 causing existing building structural damages and
`water leak into the lower floor units
`In respond to the complaint, BID open a CTS # 202303547 and conducted a site investigation
`on Thursday, 2/16/2023
` Per site verification, no visual buckling and/or deflection observed from the exposed bearing
`walls at property lines and roof/ceiling trusses which supporting the new roof deck from the
`UNIT # 2154 under construction
` Site investigation include interior of lower floor units #2152 & #2150, visual inspection only
`found minor cosmetic cracks from the units ceiling and walls. These minor damages does not
`seem warrant the cause to the claimed structural damage. However, it might caused by the
`vibration during the demolition work and/or water leak (exposed to weather) during removal of
`(E) roof for new roof construction of Unit # 2154.
` Contractor for Unit # 2154 admitted the water damages caused to lower floor unit during their
`new roof construction and is in the process to obtain permission and coordinating access for
`repair to the lower floor units
` Mr. Steven contact BID for addition water damages due to recent rain storms
` BID advised Mr. Viani, design dispute among two opposite sides license professional
`engineers is a Civil matter between two parties. It is the discretion of the involved parties to
`determine if it were merit to resolve the dispute at the court.
` BID will continue to monitor the progress of the repair work to the lower floor units done by the
`contractor of record for the Unit # 2154.
` NOV # 202303547 issued as a result of site investigation revealed addition works required
`permit revision. Specifically, the new skylights heavy metal insert ornamental, unauthorized
`rooftop unit, and the alleged hydronic heating system.

`Contractor mistakes and poor workmanship caused damage to the lower units, your response was to tell us to go to court.
`However, we showed you the lack of guard rails on the roof, heavy steel inserts used for the skylights, and design issues,
`to name a few which should trigger a NOV. You indicated a NOV for this would be developed, and the NOV issued on
`February 17, indicated stop all work. As far as the contractor was concerned, he was allowed to proceed with the work.
`We have issues with the work he is performing and would like a complete stop work declaration as he is still working and
`causing damage throughout the building.

`As mentioned during our call, my tenants in 2150 report that the construction work continues 
`at 2154 Leavenworth and further damage to the building and other units continues as well. 
`Specific instances include:

`2/28/23: Tenants in 2150 hear loud noise as recorded one level down by garage video 
`camera; they look up and realize that new cracks have appeared in the ceiling that was 
`recently patched and repainted. 
`

`3/3/23: Tenants in 2150 hear crashing sound and breaking glass; then they hear a 
`conversation between the workers with one asking if the other is okay after falling off a 
`ladder; from the outside broken glass‐ which is never swept up‐ and an additional broken 
`window pane are observed (see below).

`Broken Windows; these have occurred at various times with the most recent damage 
`occurring when the worker fell on 3/2

`Glass shards on building sidewalk from most recent accident; construction crew has not 
`bothered to clean up although on the doorstep of another owner.

`And despite the stop‐work order, the construction crew has continued to work almost daily 
`following the notice. This is documented via my tenant's doorbell camera. Watching these, 
`you see the workers coming and going from the site with various construction materials. 
`Since these are large files, I am not including the videos on this thread. But I can get you 
`access to them via google drive as needed.

`I am very concerned that this activity is creating further damage despite the city's clear 
`instruction to stop work. Please let me know if any additional information would be helpful.
