`MEMORANDUM OF POINTS AND AUTHORITIES
`
`I. Background
`The complaint, which is for declaratory relief, was filed on July 17, 2024.
`Plaintiffs have been diligently attempting to have the Defendant served with the Summons
`and Complaint; however, despite exercising diligence, Plaintiffs have been unable to locate the
`Defendant for service. Plaintiffs now request that the court permit the Summons to be served by
`publication in The San Francisco Chronicle, a newspaper of general circulation in the county in
`which the Defendant was last known to reside.
`II. Statement of Facts
`This is an action seeking declaratory relief on behalf of Plaintiffs arising from violations by
`the named Defendants below, who knowingly, willfully, and intentionally conspired and agreed to
`a course of action to defraud Plaintiffs through illegal schemes in which they leased a rental truck
`and intentionally crashed it into a target vehicle in order to make unlawful and fraudulent insurance
`claims.
`On the night of August 10, 2023, Guillory was driving the Rental Truck on Lasalle Avenue
`in San Francisco, California and allegedly backed into a 2011 Cadillac CTS-V, bearing license plate
`number 8WSL310 (the “Cadillac”), owned by Slaughter.
`Based on information and belief, Slaughter is making a property damage claim.
`Generally, in a staged motor vehicle fraud criminal enterprise, the lessee and the co-
`conspirator in the target vehicle “meet up” at a predetermined time and at a predetermined location.
`The lessee then drives a rental truck to the predestined location where the other co-conspirator is
`waiting in the target vehicle.
`In a predetermined “staged” motor vehicle crash, a rental truck is then intentionally driven
`into the target vehicle. The lessee then reports the loss to either the local U-Haul Rental Company
`or Repwest Insurance, and the target vehicle driver asserts property damage and personal injury
`claims. Plaintiff has a nationwide presence, user-friendly interface, and affordable rates, which
`have made it a target for crash staging and insurance fraud. For a nominal price, the criminal
`participants become beneficiaries of Plaintiff through the insurance on the rental truck simply by

`participating in a pre-planned staged loss.
`III. Legal Argument
`A SUMMONS MAY BE SERVED BY PUBLICATION
`California Code of Civil Procedure §415.50 permits a summons to be served upon the
`defendant by publication upon demonstration by affidavit that the party cannot be served with
`reasonable diligence personally, by mail, or by substitute service and that party, and that a cause of
`action exists against that party, or that a person is a necessary party, or the party claims an interest
`in real or personal property that is subject to the jurisdiction of the court. In the present case,
`Plaintiffs have asserted a cause of action against the Defendant, and for the reasons explained in the
`attached declaration cannot with reasonable diligence locate the Defendant. Plaintiffs searched the
`internet, public databases, social media, and were unable to locate any additional addresses for
`Defendant.
`For these reasons, Plaintiffs ask that the court permit the service of the Summons by
`publication.

`I, Dan Everakes, Esq., am the attorney of record in this matter for Plaintiffs, U-Haul Co. of
`California (“UHCA”), U-Haul Co. of Arizona (“UHAZ”), and ARCOA Risk Retention Group, Inc.
`(“ARCOA”) (collectively “Plaintiffs”) and I declare the following support of my application to
`permit service on the Defendant by publication:
`1)
`A cause of action exists against the party upon whom service is to be made, and she
`is a necessary or proper party to the action.
`2)
`Despite a diligent attempt to locate the Defendant for service, I have been unable to
`
`do so.
`
`As shown by the Non-Service Report of Priscila Carmona, the registered process

`server with personal knowledge of attempted service on Defendant hereinafter referred to as
`“process server,” attempted to serve Defendant with process in this action on the following date and
`time at the last known address for Defendant (2600 Arelious Walker Dr Apt. 206, San Francisco,
`CA 94124) obtained through a comprehensive report: August 29, 2024 at 3:09 pm. The process
`server spoke to the occupant (black male in his 40s) who stated that no one with Defendant’s name
`resides at this address. The process server’s Non-Service Report is attached hereto as Exhibit A.

`On August 30, 2024, Plaintiffs authorized One Legal to serve Defendant at 1026
`Fitzgerald Ave, San Francisco, CA 94124, but One Legal responded that this is a bad address. One
`Legal further indicated that on one side of the “park” the numbers end at 925 Fitzgerald Ave, and
`on the other side of the park the numbers begin at 1101 Fitzgerald Ave. 1026 Fitzgerald Ave does
`not reportedly exist as a residential address, because it is located in the now undeveloped land area.

`On September 12, 2024, I sent out notice of receipt and acknowledgment to
`Defendant via mail pursuant to California Code of Civil Procedure Section 415.30 to 2600 Arelious
`Walker Dr. #206, San Francisco, California 94124.

`On September 16, 2024, I sent out notice of receipt and acknowledgment to
`Defendant via mail pursuant to California Code of Civil Procedure Section 415.30 to 1026
`Fitzgerald Ave, San Francisco, CA 94124. Mail was returned as undelivered on September 27,
`2024. Defendant did not respond to the complaint.

`Plaintiffs obtained a comprehensive report for Defendant and the 2600 Arelious
