`28, Inc. (“the Parties”) have agreed to a settlement in principle of this matter. The Parties are

`memorializing their settlement, which will include a dismissal of this litigation with prejudice.
`
`The Parties are working diligently to memorialize the settlement but have not finalized
`
`their negotiations. The Parties anticipate executing a final settlement agreement and dismissing
`
`the case by December 6, 2022.
