`The Defendant, Goodyear Tire & Rubber Co. (“Goodyear Tire”), pursuant to Practice

`Book § 17—44, respectfuily moves this Court to render summary judgment in its favor as to the
`
`Plaintiffs’ claims and any Intervening Plaintiffs” claims and all cross claims. As more
`
`particularly set forth in the memorandum of law filed in support of this motion, there is no
`
`evidence that the Plaintiff’s decedent, Richard Pierce, was exposed to any asbestos-containing
`
`product allegedly manufactured or sold by Goodyear Tire. Accordingiy, Goodyear Tire is
`
`entitIed to judgment in its favor as a matter of law.
