`

`The Defense Manpower Data Center (DMDC)is an organization of the Department of Defense (DoD) that mainiains the Defense Enrollment and Eligibility
`Reporting System (DEERS) database whichIs the official source of data on eligibility for milRary medical care and othereligibilily systems.
`
`The DoD strongly supports ihe enforcement of the Servicemembers Civil Relief Act (50 USC App. ? 501 el seq, as amended} (SCRA) (formerly known as
`ihe Soldiers’ and Sailors! Civil Relief Act of 1940). DMDC has issued hundreds of thousands of "does noi possess any information indicating that the
`individual is currently on active duty" responses, and has experienced only a small error rate.
`In the event the individual referenced above, or any family
`member, friend, or represeniative asseris in any manner that ithe individual was on active duty for ihe active duty status date, or is olherwise enilied to the
`protections of the SCRA, you are strongly encouraged to obtain further verification of the person's status by contacting that person’s Service. Service contact
`inforrnaiion can be found on the SCRA website's FAQ page (Q33)via this URL: hitps://scra.dmdc.osd milfac.xhiml#O33.
`if you have evidence ihe person
`was on active duly for ihe active duty status date and you fail to obtain this additional Service verification, punitive provisions of the SCRA may be Invoked
`against you. See 50 USC App. ? 521(c}.
`
`(1) The individual's Active Duty status on the Active Duly Status Date (2) Wheiherthe individual left Active
`This responsereflects the following information:
`Duty status within 367 days preceding the Active Duly Status Date (3) Whether the individual or his/her unit received early notification io report for active
`duty on the Active Duty Status Date.
`
`More information on “Active Duty Status”
`Acitve duly status as reportedin this certificate is defined in accordance with 10 USC ? 104(d) (1). Prior to 2010 only some of the aclive duly periods less
`ihan 30 consecutive days in length were available.
`In the case of a memberof the National Guard, this Includes service under a call to active service
`aulhorized by the President or the Secretary of Defense under 32 USC ? 502(f) for purposes of responding to a national emergency declared by the
`Presideni and supported by Federal funds. All Active Guard Reserve (AGR) members must be assigned against an authorized mobilization position in the
`unit they support. This includes Navy Training and Administration of the Reserves (TARs), Marine Corps Active Reserve {ARs} and Coast Guard Reserve
`Program Administrator (RPAs). Active Duty status also applies to a Uniformed Service member whois an active duty commissioned officer of the U.S.
`Public Health Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps}.
`
`Coverage Under the SCRAis Broader in Some Cases
`Coverage under the SCRA Is broader in some cases and includes some calegories of persons on active duty for purposes of the SCRA who would not be
`reported as on Active Duty underthis certificate. SCRA protections are for Title 10 and Title 14 active duly records for all the Uniformed Services periods.
`Title 32 periods of Active Duty are not covered by SCRA,as defined in accordance with 10 USC ? 101(d){4).
`
`Many times orders are amended to extend ihe period of active duly, which would extend SCRAprotections. Persons seeking to rely on this website
`cérlification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dales of service.
`Furthermore, some protections of ihe SCRA may extend to persons who have received orders to report for active duly or to be inducted, but who have not
`actually begun active duly or actually reported for induction. The Last Date on Active Duty entry is important because a number of protections of ihe SCRA
`extend beyond the last dates of active duty.
`
`Those who could rely on this cerlificate are urged io seek qualified legal counsel to ensure thatall rights guaranteed to Service members under the SCRA
`are protected
`
`WARNING: This certificate was provided based on alast name, SSN/date of birth, and active duty status date provided by the requester. Providing
`erroneous information will cause an erroneous certificate to be provided.

`BETHZAIDA F BONDOC
`
`STATE OF OHIO
`COUNTY OF FRANKLIN
`
`Ruby Cordova, personally appeared before me, on this day and after being duly sworn, accordingto law, and
`upon myoath andstates as follows:
`
`I ama Litigation Support Specialist for DISCOVER PRODUCTSINC., successor by merger to DB
`SERVICING CORPORATION,the servicing affiliate of DISCOVER BANK, an FDIC insured Delaware
`State Bank. DISCOVER PRODUCTSINC. is responsible for, among other things, maintaining account
`recordspertaining to Discover Card accounts and interacting with Discover Card account holders with regard
`to payments owed on those accounts.
`
`This affidavit is made on the basis of my personal knowledge and in support ofthe Plaintiffs suit on account
`against the Cardmember(s).
`
`In mycapacity as Litigation Support Specialist, I have knowledge regarding, and accessto, records regarding
`the Discover Card account of the above referenced Cardmember(s). DISCOVER PRODUCTSINC.
`maintains these records in the ordinary course of its business, and the records are updated with information on
`events (such as charges and payments on the account) by individuals with personal knowledge of those events
`or by automated processes that track such eventsat or near the time that the events occur. The same systems
`that record this information also generate periodic statements that are sent to Discover Cardmember(s), and
`store copiesof these periodic statements.
`In addition, these same record-keeping systems contain information
`about which version of Discover Bank’s terms and conditions has been communicated to an account holder
`and accepted by an account holder through the use of his or her Discover Card after receipt of the terms and
`conditions.
`I have personally inspected the records pertaining to the account of the Cardmember(s),
`including the last periodic statement sent to the Cardmember(s) by DISCOVER PRODUCTSINC., to
`ascertain the applicable terms and conditions, the balance due on said account and whether the
`Cardmember(s) have made payments on that balance.
`
`According to the records maintained by DISCOVER PRODUCTSINC., during the period of timethat
`account statements were generated, such statements were either provided to the Cardmember(s)
`electronically or mailed to the Cardmember(s) at the address maintained on file during that time period.
`Accordingto the records maintained by DISCOVER PRODUCTSINC., the last known address associated
`with the Cardmember(s)is/are:
`
`20 BOULEVARD
`NEWINGTON, CT 06111-3604
`
`The accountis in default because the Cardmember(s) have not paid the amounts due and owing to Discover
`Bank on the account.
`
`The business records maintained by DISCOVER PRODUCTSINC. and described above show that the
`Cardmember(s)’ account with Discover Bank is governed by terms and conditions referredto as “terms level
`25K.” A true and correct copy of these terms and conditions have been provided to DISCOVER PRODUCTS
`INC.’s counselinthis case.
`
`Exhibit A is a true and accurate copyofthelast periodic statement sent by DISCOVER PRODUCTSINC. to

`
`

`

`the Cardmember(s), retrieved from the record-keeping system described above, and shows the amountthatis
`now due and owing Discover Bank onthe account.
`
`DISCOVER PRODUCTSINC. hasaccessto a system of records maintained by the United States Department
`of Defense, which allows DISCOVER PRODUCTSINC. to ascertain whether a particular personis engaged in
`active duty in any branchof the U.S. military.
`It is the regular practice of DISCOVER PRODUCTSINC. to
`query this system with respect to any accountholderpriorto initiating a collection action against that account
`holder. DISCOVER PRODUCTS INC. maintains records in the normal course of its business that indicate the
`results of that query. Based on my review of the account records applicable to Cardmember(s), to the best of
`my knowledge andbelief the above referenced Cardmember(s) is not engagedin anyofthe military services of
`the United States.
`
`I declare underpenalty ofperjury that the foregoingis fue and correct to the best ofmy knowledge.
