`COUNT ONE: UNJUST ENRICHMENT
`
`1. The Plaintiff, Sheriden Woods Health Care Center, Inc. d/b/a Sheriden Woods Health Care
`
`(hereinafter the “Plaintiff”), is a duly licensed chronic care and convalescentfacility located
`
`at 321 Stonecrest Drive, Bristol, Connecticut.
`
`2. On or about September 29, 2020, James Calver(hereinafter the “Resident”) was admitted as
`
`a resident / patient of the Plaintiff.
`
`

`3. Commencing on September 29, 2020, the Plaintiff began to provide the Resident with care
`
`and services including room, board, housekeeping, and general nursing care (hereinafter
`
`collectively referred to as the “Care and Services”).
`
`4, From September 29, 2020 through October 22, 2020, Medicare fully covered the cost of Care
`
`and Services provided by the Plaintiffto the Resident.
`
`5. As of October 23, 2020, Medicare no long contributed towardsthe costs of Care and Services
`
`provided by Plaintiff to the Resident and he wasaprivate pay resident.
`
`6. Plaintiff continues to provide the Resident with Care and Services at the Daily Rate and, at
`
`present, there is no intent to discharge.
`
`7. On or about February December 22, 2020, the Connecticut Probate Court for the Region 19
`
`district adjudged the Resident incapable of managinghis financial affairs and appointed Lisa
`
`Foy, the Conservator ofthe Estate ofJames Culver (hereinafter the “Defendant”).(
`
`8. The Defendantis in possession and/or contro! ofthe income, assets, or resources ofthe
`
`Resident, and to date has not paid all outstanding amounts due and owing by the Resident.
`
`9. The Plaintiff has provided Care andServicesto the Resident with expectation that it would
`
`be paid for the same.
`
`10, The Resident has benefited from receiving the Care and Services, which were necessary for
`
`his daily living and well-being.
`
`11. The Resident and/or Defendanthas been unjustly enriched in receiving Care and Services
`
`which Plaintiff has not received paymentfor in full.
`
`12. The Resident has been unjustly enriched in the amountnot less than Seventy-Seven
`
`Thousand Thirteen and 00/100 Dollars ($77,013.00) through February 28, 2021.

`13. The failure to pay for the Care and Services provided has been to the Plaintiff's detriment.

`worth Seventy-Seven Thousand Thirteen and 00/100 Dollars ($77,013.00).

`liable to the Plaintiff on the basis of quantum merit.
