`Plaintiffs Ryan O’Toole and Ami O’Toole, et al., hereby object to Defendants filings,
`
`Dkt. 135.00-137.00. None of these filings were ever served on Plaintiff per Defendants’
`
`certification. In addition, Defendants’ notice of compliance is false in several respects.
`
`Defendants’ filings contain several material misrepresentations to the Court as follows:
`

`
`“Specifically,Defendants supplemented their responses to Plaintiffs’ Requests for
`Production of Documents emailed to Attorney Petela on March 21, 2022 (Bates Nos.
`MIX PRIME 000001 – 000051).”
`This is untrue. Plaintiffs received 22 pages of production on March 21, 2022, but
`
`has received no supplements.
`
`“Defendants provided Deposition Dates for the Defendants’ witnesses”
`•
`This is untrue. See email chain, attached hereto as Exhibit A. Plaintiffs’ last request was
`
`June 7, 2022.
`
`• Defendants provided a Protective Order to govern the discovery;”
`This is not only untrue, but Defendants withdrew a motion for a protective order.

`• “Defendants agreed to provide production and interrogatory answers, subject to their
`objections, no later than July 31, 2022.”
`This is untrue. See email chain below. Plaintiff requested supplemental production
`
`by a date certain, but no response was received.

`For the foregoing reasons, Plaintiffs request this Court grant their Motion to Compel in
`
`its entirety, overrule any objections Defendants have asserted, and enter nonsuit against
`
`Defendants for making several misrepresentations to the court to further obstruct the provision of
`
`discovery ordered by the Court.
