`
`ORDER 436946
`
`BBSR, LLC
`
` V.
`ANHEUSER-BUSCH, LLC
`
`JUDICIAL DISTRICT OF HARTFORD
` AT HARTFORD
`

`
`ORDER
`
`ORDER REGARDING:
`11/14/2024 275.00 MOTION FOR ORDER
`
`The foregoing, having been considered by the Court, is hereby:
`
`ORDER:
`
`The Practice Book does not expressly authorize the appointment of a special master for the resolution of
`discovery disputes in civil cases. Cf. Practice Book § 25-32B authorizing the appointment of special
`masters for that purpose in family matters. While Practice Book § 23-14 affords wide discretion to the
`court in complex litigation docket cases, the appointment of a special master, over the objection of a
`party, is a step the court should take only cautiously and when deemed essential, absent an agreement
`between the parties. The plaintiff has not established that the appointment of a special master is
`appropriate or necessary, such that the court is prepared to exercise its discretion under § 23-14 to do so.
`
`Nor is the court persuaded, at this juncture, that an in-camera review of 2000 documents and attachments
`is necessary. Instead, the court orders the defendant to provide a more specific description of the subject
`matter of the documents withheld on the basis of privilege. This may be accomplished either by
`disclosing email “subject headings,” where doing so will not itself divulge privileged information, by
`revising the privilege log to provide a more specific description of the subject of the communication, or
`a combination of both. Also, to the extent that the privilege log does not already do so, it is to be revised
`to disclose the identity of any third parties who are recipients of communications that are claimed to be
`privileged.
`
`The revised privilege log shall be provided to the plaintiff and to the court by January 2, 2025 and the
`court will schedule a conference thereafter to address the status of the parties’ efforts to resolve the
`privilege issues and any further steps that may be taken to do so.
`
`Judicial Notice (JDNO) was sent regarding this order.
