`The Plaintiff respectfully requests to submit evidence to

`support his claim,
`
`in response to the Ryan Ryan & Deluca,
`
`Memorandum in Motion for Summary Judgement (June 23, 2016) which
`
`in part states, ’..that the Plaintiff never told the Defendants
`
`that he suffered from chronic migraine headaches brought on by
`
`reading text and required a reasonable accommodation.’
`
`I seek to introduce to the Court of record both email
`
`correspondence,
`
`the Plaintiffs motions, and the Defendants
`
`objections to motions from other cases where these requests were
`
`made in the past, before this complaint was initiated.
`
`

`Also, I would like to point out that this is the first time,
`
`in
`
`this case, or any case that Ryan Ryan & Delcua has referenced an
`
`ADA Coordinator for the Town of Waterford.
`
`I wish to understand
`
`when this position was initiated, and why I was never directed
`
`there previously.

`The laintiff does not have a “disabili ” as defined in the Americans with Disabilities
`
`
`Act and is thus not afforded its protections.
`
`
`
`The plaintiff requests, pursuant to Title II of the Americans with Disabilities Act (“ADA”),
`
`that all court proceedings be recorded “and made available on the judicial website to make
`
`government more accessible to people with impairments such as myself.” In addition, the plaintiff
`
`- requests that all depositions be videotaped and posted online “in an effort to make governmental
`
`proceeding[s] more accessible.” “The [e']qual lpjrotection [c,]lause of the [flourteenth [a]mendment
`
`to the United States [fcilonstitution is essentially a direction that all persons similarly situated should
`
`be treated alike.” Brooks v. Sweeney, 299 Conn. 196, 218 (2010). The ADA,42 U.S.C.§ 1210] gt
`

`se_q, which was passed using Congress’s power to enforce the Fourteenth Amendment, states that “no
`
`qualified individual with a disability shall, by reason of such disability, be excluded from
`
`participation in or be denied the benefits of services of the services, programs, or activities of a
`
`public entity, or be subjected to discrimination by such entity.” 42 U.S.C. § 12132. The ADA
`
`defines a “disability” as follows: “(A) a physical or mental impairment that substantially limits one
`
`or more major life activities of such individual; (B) a record of such an impairment; or (C) being
`
`regarded as having such an impairment.” 42 U.S.C. § 12102. “Major life activities include, but are
`
`not limited to, caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping,
`
`walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking,
`
`communicating, and working.” Lc_l_. Furthermore, “[a]n individual meets the requirement of ‘being
`
`regarded as having such an impairment’ if the individual establishes that he or she has been subjected
`
`to an action prohibited under this Act because of an actual or perceived physical or mental
`
`impairment whether or not the impairment limits or is perceived to limit a major life activity.” _I_d_,
`
`The plaintiff must establish three elements to prevail on a claim under Title II of the ADA:
`
`“(1) [that] he or she is a ‘qualified individual with a disability‘; (2) [that] he or she is being excluded
`
`from participation in, or being denied the benefits of some service, program, or activity by reason of
`
`his or her disability; and (3) [that] the entity [that] provides the service, program, or activity is a
`
`public entity.” Mercer v. Champion, 139 Conn. 216, 229 (2012). The plaintiff does not have a
`
`“disability” as defined in the ADA. He indicated that he filed these motions to make “government
`
`more accessible,” but this is not one of the major life events which would entitle the plaintiff to
`
`claim a “disability” under the ADA. Furthermore, the plaintiff has provided no proof that he has a
`

`“disability” as defined in the ADA. Finally, he has not show that he has been denied the benefits of a
`
`service, program, or activity because of his disability. Accordingly, the defendants request that his
`
`motions be denied.
`
`b.
`
`Depositions are not judicial documents and are not to be disclosed.
`
`The defendants do not object to the plaintiff’s request to videotape all depositions. However,
`
`the defendants do object to the plaintiff’s request to post the depositions in this matter online. “[T]he
`
`public has a common law presumptive right of access to [judicial] documents. . .and likely a
`
`constitutional one as well.” Rosado V. Bridgeport Roman Catholic Diocesan Corp, 276 Conn. 168 ,
`
`216-17 (2005). A judicial document “must be relevant to the performance of the judicial function
`
`and useful in the judicial process.” Rosado v. Bridgeport Roman Catholic Diocesan Corp., 292
`
`Conn. 1, 43 (2009); gag United States v. Amodeo, 44 F.3d 141, 145 (2d Cir. 1995). The
`
`Practice Book indicates that documents filed with the court shall be presumptively available to the
`
`public. Practice Book § 1 1-20A(a). However, that right does not extend to documents that have not
`
`been filed with the court.
`
`In B_9_sagg, the Connecticut Supreme Court held that two deposition transcripts that were not
`
`filed in connection with any motion were not judicial documents and were exempt from disclosure.
`
`292 Conn. at 52-53. Here, the plaintiff has filed a motion seeking to publicize al_l_ depositions,
`
`although the depositions have yet to be taken and have not been used in support of or in opposition to
`
`any motion. As such, his motion should be denied.
`

`Conclusion
`
`The plaintiff has cited no authority for the proposition that the Court may issue an order
`

`permitting the parties to post depositions or court proceedings online. Accordingly,the undersigned
`
`defendants respectfully request that the Court deny the plaintiff’s Motion to Have All Proceedings
`
`Properly Recorded and Available Online and the plaintiff’ s Motion to Videotape and Post Online All

`The undersigned defendants, Ryan Ryan Deluca LLP, Michael T. Ryan, and Michael C.

`Barbarula, object to the plaintiff, Adam P. McN'iece’s, Motion for Release of Audio Recordings,
`
`dated September 17, 2014 (entry 126.00).
`
`The plaintiff argues that the Court should release the “recordings of open to the public
`
`courtroom proceedings” to him so that he can prepare for trial and so that he “will better be able to
`
`self represent.” It appears to defense counsel that the plaintiff has requested that the court release the
`
`recordings of all court proceedings. This motion, therefore, seeks relief which the court is not
`
`empowered to give. There is nothing in the case law, Connecticut General Statutes, or the Practice
`
`Book which permits a court to release audio recordings of courtroom proceedings on motion.
`
`Accordingly, the defendants respectfully request that the Court deny the plaintiff’s motion.

`OBJECTION TO MOTION FOR JUDGEMENT

`I object to this motion because it is based upon multiple
`
`motions to strike. This case centers around a municipal
`
`attorneys duty to inform the public and has survived
`
`previous motions to dismiss, and motions to strike.
`
`I
`
`rewrote a portion at the courts direction. Did the court
`
`purposefully mislead me? Fundamentally, motions to strike
`
`are unjust because they impact a citizens right of free
`
`speech. This Judge would have me rewrite the complaint
`
`over and over until it is diluted to the point of nonsense.
`
`I have a visual defect as a result of the aging
`
`process.
`
`I request the audio transcript of the entire case
`
`which is known to be the publics domain. This impairment or
`
`handicap makes my life difficult because I struggle to read
`
`the tape measure or follow the path of the saw. when I work
`
`atop the 40ft ladder I realize I am not as agile as I was
`
`25 years ago. At dinner,
`
`I have menu's read to me, and eat
`
`without seeing the food with clarity. This is a physical
`
`defect which is readily self identifiable. Other defects of
`
`

`
`the mind are not so easily identified.
`
`I have great respect for all Judges whom have a most
`
`arduous task usually late in life's journey.
`
`I have
`
`concerns that the explanation for this Judge allowing
`
`multiple motions to strike may be diminished capacity as
`
`evidenced by his unintelligible written decisions which are
`
`devoid of logic.
`
`As a pro—se I would never be allowed multiple motions
`
`to strike.
`
`I have also been denied my right of discovery
`
`and deposition, as the Judge has obviously hobbled this
`
`case.
`
`I ask how Honorable Chase T. Rogers in her
`
`administrative capacity what safeguards are in place to
`
`protect the public from the ravages of time, and is this a
`
`indication of when retirement is overdue? As a ordinary
`
`carpenter I realize my prospects dim as my vision fails,
`
`and shortly will hang my belt on the peg I built for that
`
`purpose.
`
`I generally consider myself a likable fellow but some
`
`dislike me for my outspoken words of progress for humanity.
`
`Perhaps the Judge has a pro—se bias. We all know that the
`
`brotherhood of a reluctant self regulating profession
`
`dislike pro—se parties immensely.
`
`It could be that the Judge has been directed from above
`
`to short change justice. It's no secret that I advocate for
`
`CT Judicial to evolve quickly to catch up to other States
`
`by using court monitors over reporters, and allowing
`
`citizens to seek supreme justice as a constitutional
`
`

`
`birthright. This Judge may harbor resentment because I gave
`
`CT first opportunity to address these issues.
`
`I did not
`
`name him in the Federal complaint, and publicly apologize
`
`to Judge Moukawaser for errors I committed as an
`
`inexperienced pro-se.
`
`I hope to be better in my new career
`
`for I continue to learn much since I started,
`
`to protect
`
`the public in Waterford from unannounced warrantless
`
`administrative searches.
`
`In conclusion,
`
`I would prefer not to appeal this case
`
`and be afforded a full and fair hearing.
`
`Perhaps the Judge
`
`did not realize the case has survived a motion to dismiss,
`
`and a previous motion to strike in which I made changes to
`
`my complaint under objection,
`
`to comply with the courts
`
`direction. Why would he grant a subsequent motion to strike
`
`all counts? Either he will correct his error, or the next
`
`court will find this procedure unjust.
`
`In any case,
`
`I
`
`predicted his decision and included it in the Federal
`
`Complaint so hopefully there will be a discussion on free
`
`speech in a valid complaint to advance human jurisprudence.
`
