`Introduction:
`
`On June 3, 2024, Defendant’s pet Pit Bull “Reggie” attacked Plaintiff's pet “Remi” resulting
`in “Remi’s” vet hospitalization and Plaintiff’s incurring $7,223.96 in vet medical expenses.

`The purpose of this Memo is to both detail and summarize Plaintiffs communications with
`the defendant; provide the court with pertinent information to support Plaintiffs claims;
`Plaintiff's forced to bring this matter to this court due to defendant’s refusal to reimburse or
`share in Plaintiff’s vet costs and Mr. Cyr’s refusal to provide his Renter’s insurance
`information to Plaintiff’s for the purpose of filing and satisfying Plaintiff's claims.
`
`The defendant informed Plaintiff (Lovallo) that filing a claim against his Renter’s Insurance
`Provider could both result in higher premiums and/or making it difficult to obtain future
`renter’s insurance covering “Reggie” or another pet dog. Therefore, Mr. Cyr refused to
`provide Plaintiff's with Defendant’s Renter’s Insurance information to file a claim.
`
`The Defendant was negligent in not replacing the fence immediately after Defendant
`witnessed our dogs barking at each other. After this incident, the defendant informed
`Plaintiff of the incident. The plaintiff told Mr. Cyr at least two weeks before the attack that
`immediate action to replace the defendant’s inadequate fence was required.
`Unfortunately, for the plaintiff’s, “Remi, and our family the lack of Mr. Cyr’s sense of
`urgency resulted in all of us suffering from Mr. Cyr’s neglect and negligence.

`Plaintiff’s Full Chronology of Events
`
`Approximately within one month prior to “Reggie’s” attack, June 2024 attack on “Remi”, Mr.
`Cyr installs a small 3’ x 3’picket fences (no photo available) and unleashes “Reggie”.
`
`Again, Mr. Cyr unleashes his Pit Bull “Reggie” in his backyard. Less than a week later, Mr.
`Cyr informs me of a barking incident between the dogs by the fence. He tells me “Reggie”
`was upset by “Remi” and Mr. Cry became indignant. (Like how dare he bark and threaten
`my dog.) | (Mr. Lovallo) wasn’t present. | told Mr. Cyr that he should immediately replace
`the fence where our dogs couldn’t see or encounter each other. | believe a week went by
`and | reminded Mr. Cyr again. After two weeks from the barking incident, on June 2"? |
`stopped Mr. Cyr again while he was kayaking on the Lake. | pretty much repeated what |
`had told him two weeks ago, how the fence had to be replaced to prevent our dogs from
`seeing or encountering each other.
`
`June 3, 2024 - “Reggie’s” attacked “Remi” and “Remi is rushed to a vet hospital.
`
`June 3, 2024- Mr. Lovailo returns from vet hospital and takes photo of repaired picket
`fence by Mr. Cyr. See Exhibit #4B & 4C - Note: Mr. Cyr wouldn’t leash “Reggie”.

`June 5, 2024 - Mr. Cyr repairs the fence where dogs cannot see or encounter each other.

`July 8, 2024 -
`Highlights Incidents/Mr. Cyr’s Statements Worth Noting:
`
`- “Reggie’s” attack on “Remi” and harassment complaints of Plaintiff(s) See

`- After “Reggie’s” attacked, Mr. Cyr told me that he is having “Reggie” “receive
`additional obeyance training.”
`
`- Mr. Cyr told me “Reggie” had my “scent” which scares me from that day on.
`
`

`
`
`As | recall, in January 2024, Defendant, Mr. Cry, rented the house next door and moved in
`with his “muscular” Pit Bull “Reggie”. Mr. ’s pit bull was always leashed in his backyard.
`
`In late April or early May 2025, Plaintiff, Mr. Lovallo, had a neighborly conversation with Mr.
`Cyr in the street at the front of Plaintiff’s driveway. Mr. Cyr was accompanied by and
`introduced his daughter and Pit Bull “Reggie”. Having a fear of Pit Bulls, Lovallo didn’t
`approach Mr. Cyr, stepping off my front steps staying at least 50’ from Mr. Cyr with “Reggie”
`sitting at Mr. Cyr’s feet. Mr. Cyr told me that “Reggie was a friendly and gentle dog who
`played with both dogs and children”. Well into our conversation, Mr. Cyr then invited me to
`attend his daughter's backyard birthday party that weekend. Due to my fear of Pit Bulls, |
`did not attend.
`
`Only later after “Reggie’s” attack on “Remi” did | find out that his statement above
`describing “Reggie” as a friendly and gentle dog was a myth and untrue.
`
`We are here today due to Mr. Cyr’s silly and ludicrous contention that our 18.5 lb.
`standing 12” tall “lap” dog “Remi” broke through defendant’s wooded picket fence to
`attack “muscular” “Reggie” standing at 24+” estimated weight @ 30-50 lbs. Dragged
`“Reggie” into Mr. Cyr’s backyard property all the while “Remi” was in “Reggie’s” jaws
`yelping loudly. Mr. Cyr told me he separated the dogs on his property before | could
`enter his yard myself passing my daughter who had fainted. I then saw “Remi” run
`back into our yard toward me through the dangling and dislodge pickets on the fence
`bleeding from his head and face. Within 15 minutes “Remi” was on the way to the vet
`
`hospital where he was hospitalized for 5 days.
`
`Since Mr. Cyr asserts that “Remi” was on his property, broke through his picket fence
`and then attacked his muscular Pit Bull, consequently, Mr. Cyr asserted, he is not
`liable nor responsible for “Remi’s” injuries and hospitalization. Telling me all of this
`with a serious and straight face, only to insult my and this court’s intelligence. (I know
`now Mr. Cyr knew the legality on how to extricate himself from any liability from
`“Reggie’s” attack on “Remi”.)
`
`Plaintiff’s History with prior renter’s vicious Pit Bull August 2021 through October 2023.
`
`The prior renter moved in and leashed both his dogs on his property for the entire time of
`his rental. Days after the renter moved in, the Pit Bull’s leash saved Plaintiff from being
`attacked by my lake front boarding the renter’s property. The 3 ft’ open lake wall gap was
`unfenced during the entire rental period. During the Plaintiffs’ entire unfenced
`homeownership period (April 2018 through April0 2024) “Remi” never entered our
`neighbor’s unfenced back yard nor did their dogs ever enter our backyard. (Exhibit #4 A)

`Summary:
`
`Mr. Cyr gave me a false sense of security that his Pit bull “Reggie” was gentle and friendly.
`“Reggie” attacked “Remi” and me from Mr. Cyr’s side of the fence without any warning.
`It took Mr. Cyr only two days after “Remi’s” attack to replace his inadequate picket fence.
`
`Mr. Cyr had no sense of urgency to replace the fence knowing “Reggie” would not be injured
`by “Remi” due to his small size and Mr. Cyr’s knowledge of “Reggie’s” superior size.
`
`For Some unknown reason, | realize that Mr. Cyr has some hidden animus towards us and
`is still giving us unleased “Reggie” anxiety on an ongoing basis when we are on our dock.
`
`My daughter, Michele, and our three granddaughters suffered for many weeks watching
`and helping “Remi” recover from his serious wound’s day and night. As “Remi” often cried
`out in pain, we were all hurting as well.
`
`Furthermore, several months ago Mr. Cyr called the Wolcott police to report | was
`harassing him.
`
`Mr. Cyr even turned our former neighbor and his landlord, Mr. O’Conner, who we were
`always friendly with - against us.... just more grief!
`
`Our only salvation is to have Mr. Cyr’s vicious Pit Bull “Reggie” leashed in his backyard.
