`Defendant Apple Inc. (“Apple”) writes to inform Your Honor regarding the status of inter
`partes review proceedings involving the patents-in-suit. Yesterday, the Patent Trial & Appeal
`Board granted both of Apple’s petitions for institution of inter partes review of U.S. Patent No.
`9,100,826. See Ex. A (Decision Granting Institution of Inter Partes Review in Case IPR2018-
`00810); Ex. B (Decision Granting Institution of Inter Partes Review in Case IPR2018-00813).
`With the exception of claim 6, all asserted claims of this patent-in-suit are under review in the
`aforementioned proceedings.
`
`The PTAB also granted one of Apple’s petitions for institution of inter partes review of
`U.S. Patent No. 9,530,137, see Ex. C (Decision Granting Institution of Inter Partes Review in
`Case IPR2018-00809), and denied the other, see Ex. D (Decision Denying Institution of Inter
`Partes Review in Case IPR2018-00808). The same claims were challenged in each petition. With
`the exception of claims 3 and 4, all asserted claims of this patent-in-suit are under review in Case
`IPR2018-00809.

`As a result of these decisions, and together with third-party Unified Patents, Inc.’s ongoing
`inter partes review of U.S. Patent No. 8,577,813, three of the four patents asserted in this litigation
`are now undergoing inter partes review. Apple expects to receive institution decisions on its two
`petitions challenging the fourth patent-in-suit, U.S. Patent No. 8,856,539, by the end of November,
`and on its three Covered Business Method petitions challenging U.S. Patent No. 8,577,813 by mid-
`December.
`
`Apple will continue to keep the Court apprised of activity in the U.S. Patent & Trademark
`Office related to this litigation. Should Your Honor have any questions or concerns, counsel are
`available at the Court’s convenience.
