`I am a Principal at The Brattle Group, Inc. (“Brattle”) and Co-Chair of Brattle’s
`
`Intellectual Property Practice. Much of my practice involves analyzing various economic issues
`
`related to intellectual property. I have consulted on behalf of clients in intellectual property
`
`matters before United States District Courts, including on the topics of patent damages and
`
`economic injury from misappropriation of trade secrets. I have also consulted on behalf of clients
`
`in Section 337 matters before the U.S. International Trade Commission. I also specialize in
`
`applying the tools of economic analysis to policy questions and have performed numerous policy
`
`analyses across various industries. I received my Ph.D. in Economics from Boston College. I
`
`also hold an A.B. in Economics and Mathematics magna cum laude from Mount Holyoke
`
`College. I have provided economic expertise in numerous cases in courts throughout the country.

`In February 2024, I provided trial testimony in the above-referenced matter on
`
`behalf of Wirtgen America, Inc. (“Plaintiff” or “Wirtgen”) on the topic of economic damages. I
`
`understand that, following trial in this matter, the jury determined that Caterpillar willfully
`
`infringed five of Wirtgen’s patents and awarded a verdict in favor of Wirtgen for $12.9 million.1
`
`I understand the Court has not yet entered judgment.
`

`For this declaration, I have been asked by Patterson Intellectual Property Law,
`
`P.C. and Sterne, Kessler, Goldstein & Fox P.L.L.C., counsel for Wirtgen, to provide economic
`
`input into the calculation of prejudgment interest.
`
`I.
`
`PREJUDGMENT INTEREST
`

`
`I understand that an award of prejudgment interest is at the discretion of the Court
`
`and that Wirtgen is requesting prejudgment interest at the Bank Prime Loan Rate compounded
`
`quarterly. As such, I calculated prejudgment interest starting from April 29, 2016 for the ’309,
`
`

`’641, and ’788 patents; May 23, 2017 for the ’530 patent; and September 2, 2021 for the ’972
`
`patent, using the per annum Bank Prime Loan Rate reported at the quarterly average level by the
`
`St. Louis Federal Reserve, compounded quarterly and using a mid-period convention.2
`

`I have been directed to use the Bank Prime Loan Rate as published by the St.
`
`Louis Federal Reserve, which is used for bank borrowing and represents a lower-end commercial
`
`lending rate. This interest rate compensates Wirtgen, as the patent holder, for the borrowing risk
`
`inherent in a damages amount that has, in effect, been held at risk by Caterpillar over the
`
`duration of the damages period. The nature of this risk is that Caterpillar would be unable to pay
`
`its obligations. This risk is priced by markets in what it requires Caterpillar to pay to borrow
`
`money. The Bank Prime Loan Rate is standing in as a proxy for Caterpillar’s cost of debt. This
`
`interest rate is greater than the risk-free rate, which does not compensate Wirtgen for the risk of
`
`held funds, and is lower than a weighted average cost of capital interest rate, which would
`
`compensate Wirtgen for alternative uses of the funds. I understand that the Bank Prime Loan
`
`Rate has been used in other cases in the District of Delaware.3
`

`For the relevant time period up to the date of the jury verdict, I used annual
`
`prejudgment interest rates reported on a quarterly basis ranging from 3.25% to 8.50% between
`

`damages.4 At present, I have calculated prejudgment interest based on the awarded verdict of
`
`approximately $12.9 million—which is premised on Caterpillar’s sales data produced before
`
`trial. First, I calculated the effective damages in each quarter based on the jury verdict awarding
`
`a reasonable royalty of $12.9 million.5 Next, I calculated prejudgment interest in each quarter
`
`based on a mid-period sales convention, assuming the sales occurred at the middle of each period
`
`and compounding quarterly through the date of the jury verdict based on the interest rate
`
`described above.6 In total, I calculated prejudgment interest through the date of the verdict on the
`
`jury verdict amount based on Caterpillar’s currently produced sales data to be equal to
`
`$2,920,084.65.7
`

`When the Court enters judgment, I am also available to calculate prejudgment
`
`interest on the jury verdict amount ($12.9 million) from the date of the verdict up to the date the
`
`Court enters judgment.
