`the following Final Infringement Contentions concerning the infringement by Defendant

`Preliminary Statement
`
`Wirtgen America provides its Final Infringement Contentions subject to the following
`
`objections and reservation of rights:

`Wirtgen America has prepared these contentions based on information and discovery
`
`currently available. Fact discovery remains open and expert discovery has not yet begun in this
`
`case. Furthermore, Wirtgen America’s investigation into the infringement of the Asserted Patents
`
`is ongoing, especially since Caterpillar’s discovery production remains deficient. Based on
`
`current discovery, Caterpillar’s PM600 series milling machines (including the PM620 model and
`
`the PM622 model), the PM800 series milling machines (including the PM820 model, the PM822
`
`model, and the PM825 model), and the PM300 series milling machines (including the PM310
`
`model, the PM312 model, and the PM313 model) (collectively, “Accused Milling Machines”), as
`
`well as Caterpillar’s rotary mixers (including the RM600 model and RM800 model) (“Accused
`
`Rotary Mixers”) (the Accused Milling Machines and Accused Rotary Mixers collectively,
`
`“Accused Machines”), appear to infringe, both directly and indirectly, the asserted claims of the
`
`Asserted Patents, as detailed herein.
`
`Therefore, Wirtgen America reserves the right to supplement and/or amend these
`
`contentions as discovery in this case progresses or in light of any modification or clarification of
`
`Caterpillar’s non-infringement or invalidity contentions.
`
`These contentions are made pursuant to Federal Rule of Evidence 502 and the Protective
`
`Order (D.I. 61) entered in this case. To the extent that these contentions contain any information
`
`that may be protected from discovery under the attorney-client privilege, the work-product
`
`doctrine, the common-interest privilege, or any other applicable privilege or immunity, such
`
`disclosure is inadvertent and does not constitute a waiver of any such privilege or immunity.
`
`By submitting these contentions, Wirtgen America does not waive any claims or defenses
`
`that may be asserted in this case. These contentions may be asserted in the alternative and do not

`constitute any concession by Wirtgen America.
