`
`I.
`
`Preliminary Statement
`
`Plaintiff provides its Initial Infringement Contentions subject to the following objections
`
`and reservation of rights:
`
`Wirtgen America’s investigation is ongoing and discovery and claim construction are not
`
`yet complete. For example, Caterpillar’s discovery production remains deficient; Wirtgen
`
`America still expects to receive technical presentations, review source code for the Accused
`
`Products, and inspect the Accused Milling Machines. Based on current discovery, Caterpillar’s
`
`PM600 series milling machines (including the PM620 model and the PM622 model), the PM800
`
`series milling machines (including the PM820 model, the PM822 model, and the PM825 model),
`
`and the PM300 series milling machines (including the PM310 model, the PM312 model, and the
`
`PM313 model) (collectively, “Accused Milling Machines”) appear to infringe, both directly and
`
`indirectly, the asserted claims of the asserted patents, as detailed herein.
`
`Plaintiff reserves the right to supplement and/or amend the asserted claims and
`
`infringement contentions as discovery progresses. Moreover, the parties have not exchanged
`
`proposed claim constructions or claim terms for construction and the Court has not yet construed
`
`the claims. In addition, expert discovery has not yet begun.
`
`By submitting these contentions, Plaintiff does not waive any claims or defenses that may
`
`be asserted in this case. These contentions may be asserted in the alternative and do not
`
`constitute any concession by Plaintiff for purposes of claim construction or infringement, nor
`
`does Plaintiff waive any arguments that may be made or position that may be taken regarding the
`
`proper construction of any claim term.
`
`Plaintiff objects to the disclosure of information that is protected by the attorney-client
`
`privilege, attorney work-product immunity, the common-interest privilege, or any other

`applicable privilege or immunity. To the extent Plaintiff inadvertently discloses information that
`
`may be protected from discovery under the attorney-client privilege, the attorney work-product
`
`immunity, or any other applicable privilege or immunity, such inadvertent disclosure does not
`
`constitute a waiver of any such privilege or immunity.
`
`II.
`
`Asserted Claims
`
`Plaintiff contends that Caterpillar’s Accused Milling Machines infringe, directly and
`
`indirectly, one or more of the patents-in-suit under 35 U.S.C. § 271(a), (b), or (c) either literally
`
`or through the doctrine of equivalents as shown in the attached claim charts:
`

`
`Appendix A);
`
`• Claims 1-20 of the ’316 patent (claim chart attached as Appendix B);
`
`• Claims 11, 12, and 15-19 of the ’641 patent (claim chart attached as Appendix C);

`
`• Claims 1-20, 23-26, and 28 of the ’530 patent (claim chart attached as
`
`Appendix F);
`
`• Claims 1, 3, 5–8, 10–14, 15, 17, and 19 of the ’788 patent (claim chart attached as

`
`Milling Machines); and
`
`• Claims 8-15 of the ’391 patent (claim chart attached as Appendix O for Compact
`
`Milling Machines).
`
`Plaintiff’s Initial Infringement Contentions are meant to be illustrative, and in no way
`
`limit Plaintiff’s ability to rely on other documents or information or other portions of cited
`
`documents.

`roller. See claim 17.
`
`Because each of the four elevation cylinders is made from the samepart, the ride control feature causes the
`symmetrical displacement of each elevation cylinder in equal and opposite directions to the two immediately
`adjacent cylinders, producing a diamond-shapedstability pattern with vertices along the mid-points between each
`adjacent pair of cylinders. The widest transverse dimension of this diamond-shapedstability pattern (denoted by the
`dashedline below)is therefore along a transverse line mid-way between the front and rear elevation cylinders. See
`claim 17.
`
`Whenthe ride control feature of Caterpillar’s PM620is activated, the Accused Large Milling Machinehas a four-
`sided stability pattern formed by the elevation cylinders that are made from the samepart, located at the rectangular
`corners of the machine, and are hydraulically coupled so that the left front track and the right rear track are adjusted
`in height in the same direction and in an opposite direction to the right front track and the left rear track. See claim
`17.
`
`The footprint of the workingroller or rotor is located at the center of the machine between the front and rear tracks or
`tracks. See claim 17.
`
`Accordingly, the widest transverse dimensionofthe stability pattern therefore falls on the footprint of the working
