`Pursuant to paragraph 4(c) of the Default Standard for Discovery of the United States

`District Court for the District of Delaware, and this Court’s July 23, 2021 Scheduling Order

`(D.I. 28), Wirtgen America, Inc. (“Plaintiff” or “Wirtgen America”) hereby provides the
`
`following Initial Infringement Contentions concerning the infringement by Defendants
`
`Caterpillar, Inc. (“Defendant” or “Caterpillar”) of U.S. Patent No. 7,828,309 (“the ’309 patent”),
`
`U.S. Patent No. 8,118,316 (“the ’316 patent”), U.S. Patent No. 7,530,641 (“the ’641 patent”),
`
`U.S. Patent No. 8,113,592 (“the ’592 patent”), U.S. Patent No. 9,010,871 (“the ’871 patent”),
`
`U.S. Patent No. 9,656,530 (“the ’530 patent”), U.S. Patent No. 7,946,788 (“the ’788 patent”),
`
`U.S. Patent No. 8,511,932 (“the ’932 patent”), U.S. Patent No. 8,690,474 (“the ’474 patent”),

`U.S. Patent No. RE48,268 (“the RE268 patent”), U.S. Patent No. 8,424,972 (“the ’972 patent”),

`I.
`
`Preliminary Statement
`
`Plaintiff provides its Initial Infringement Contentions subject to the following objections
`
`and reservation of rights:
`
`Wirtgen America’s investigation is ongoing and discovery and claim construction are not
`
`yet complete. For example, Caterpillar’s discovery production remains deficient; Wirtgen
`
`America still expects to receive technical presentations, review source code for the Accused
`
`Products, and inspect the Accused Milling Machines. Based on current discovery, Caterpillar’s
`
`PM600 series milling machines (including the PM620 model and the PM622 model), the PM800
`
`series milling machines (including the PM820 model, the PM822 model, and the PM825 model),
`
`and the PM300 series milling machines (including the PM310 model, the PM312 model, and the
`
`PM313 model) (collectively, “Accused Milling Machines”) appear to infringe, both directly and
`
`indirectly, the asserted claims of the asserted patents, as detailed herein.
`
`Plaintiff reserves the right to supplement and/or amend the asserted claims and
`
`infringement contentions as discovery progresses. Moreover, the parties have not exchanged
`
`proposed claim constructions or claim terms for construction and the Court has not yet construed
`
`the claims. In addition, expert discovery has not yet begun.
`
`By submitting these contentions, Plaintiff does not waive any claims or defenses that may
`
`be asserted in this case. These contentions may be asserted in the alternative and do not
`
`constitute any concession by Plaintiff for purposes of claim construction or infringement, nor
`
`does Plaintiff waive any arguments that may be made or position that may be taken regarding the
`
`proper construction of any claim term.
`
`Plaintiff objects to the disclosure of information that is protected by the attorney-client
`
`privilege, attorney work-product immunity, the common-interest privilege, or any other
`

`applicable privilege or immunity. To the extent Plaintiff inadvertently discloses information that

`may be protected from discovery under the attorney-client privilege, the attorney work-product

`immunity, or any other applicable privilege or immunity, such inadvertent disclosure does not
`
`constitute a waiver of any such privilege or immunity.

`sided stability pattern formed by the elevation cylinders that are made from the samepart, located at the rectangular
`corners of the machine, and are hydraulically coupled so that the left front track and the right rear track are adjusted
`in height in the same direction and in an opposite direction to the right front track and the left rear track. See claim
`17.

`The footprint of the workingroller or rotor is located at the center of the machine between the front and rear tracks or
`tracks. See claim 17.

`Accordingly, the widest transverse dimensionofthe stability pattern therefore falls on the footprint of the working
