`256. Claim 17 and 29 each recite that the “four sided stability pattern
`
`having a widest transverse dimension, transverse to a forward direction of the
`
`chassis, which widest transverse dimension falls within a footprint of the working
`
`roller or rotor.” The PM600 and PM800 machines meet this limitation.
`
`257. As explained above in Section X.D.1, regarding claims 1 and 26,
`
`when the ride control feature is activated, the PM620 includes four leg cylinders
`
`that are positively coupled together such that the left front track and the right rear
`
`track are adjusted in height in the same direction to each other and in the opposite
`
`direction to the right front wheel or caterpillar and the left rear wheel or caterpillar.
`
`As such, the adjacent pairs of tracks move as if they were on an imaginary pivoting
`
`axle between the tracks. For example, the left front track and the left rear track
`
`move as they were on an imaginary pivoting axle, and the left front track and the
`
`right front track move as they were on an imaginary pivoting axle.
`
`258. The pivot point of this imaginary axle will be at the midpoint of the
`
`line passing through each adjacent pair of tracks. The PM620 hydraulic cylinders
`
`(i.e., actuating member) in each leg of the PM620 are designed identically (i.e.,

`made from the same part). There are no accumulators in the hydraulically circuit of

`the ride control configuration.

`
`108:1, 151:11-20. This configuration thus creates an imaginary axle between
`
`adjacent tracks that pivots at the midpoint between the tracks.

`259. With an imaginary axle between adjacent tracks that pivots at the
`
`midpoint, the resulting stability pattern of the PM620 is diamond shaped as shown
`
`below in the annotated image.
`
`
`
`
`
`CAT0055043. The annotated blue diamond is the resulting stability pattern of the
`
`PM620. The vertices of the diamond-shaped stability pattern are located at the
`
`midpoints between adjacent pairs of lifting claim. Again, this is due to the pivot
`
`points of the imaginary axles being located at the midpoint. As shown in the above
`
`image, the widest transverse dimension (dashed blue line) of the diamond-shaped
`
`stability pattern falls within the footprint of the milling drum.
`
`260. In addition to the literal infringement outlined above, it is also my
`
`opinion that Caterpillar’s PM620 machine infringes the above limitation of claims
`
`17 and 29 under the doctrine of equivalents. To the extent that any differences may
`
`exist between the PM620 machine and the features disclosed in claims 17 and 29
`
`of the ‘309 patent, a POSA would have understood these differences to be
`
`insubstantial. Indeed, to the extent that any such differences exist, it is nonetheless

`my opinion that the PM620 machine includes a substantially similar connected
`
`
`
`hydraulic cylinders that are intended to perform substantially the same function, in
`
`substantially the same way, to achieve substantially the same result as the above
`
`limitation of claims 17 and 29. Thus, it is my opinion that this limitation is also
`
`met under the doctrine of equivalents.
`
`261. Accordingly, the PM620 includes a “four sided stability pattern
`
`having a widest transverse dimension, transverse to a forward direction of the
`
`chassis, which widest transverse dimension falls within a footprint of the working
`
`roller or rotor,” as recited in claims 17 and 29.
`
`XI. Objective Indicia of Nonobviousness
`262. In this investigation, Respondents contend that the Asserted Patents
`
`are invalid due to obviousness. See Respondents’ Seventh Supplemental Responses
`
`to Complainant Wirtgen America’s First Set of Interrogatories, Jan. 3, 2018, Exs. 2
`
`and 5; Respondents’ Ninth Supplemental Responses to Complainant Wirtgen
`
`America’s First Set of Interrogatories, Jan. 17, 2018, Ex. 7. To rebut an
`
`obviousness contention, I understand that evidence related to the intrinsic or
`
`scientific features of a patent as well as additional evidence regarding certain
`
`“objective indicia” of non-obviousness may be present.
`
`263. I understand that such objective indicia include fulfillment of a long
`
`felt but unresolved need, failure of others, copying of that product by competitors,
