`The Commissioninstituted this investigation on November 29, 2017, based on a
`
`complaint filed by Caterpillar Inc. of Peoria, Illinois and Caterpillar Paving Products, Inc. of
`
`Minneapolis, Minnesota (collectively, “Caterpillar” or “Complainants”). See 82 Fed. Reg.
`
`56625-26 (Nov. 29, 2017). The complaint, as supplemented,alleges violations of section 337 of
`
`the Tariff Act of 1930, as amended (19 U.S.C. § 1337) (“section 337”), based upon the
`
`importation into the United States, the sale for importation, and the sale within the United States
`
`after importation of certain road construction machines and components thereof by reason of
`
`infringement of claims 1, 15-19, 24-28, 36, and 38 of U.S. Patent No. 7,140,693 (“the ’693
`
`patent”)!; claims 1-5, 8, 9, and 12-17 of U.S.Patent No. 9,045,871 (“the ’871 patent”); and
`
`claims 1-3, 7, and 8 of U.S. Patent No. 7,641,419 (“the °419 patent”). See id. The notice of
`
`investigation identifies the following respondents: Wirtgen GmbH of Windhagen, Germany;
`
`Joseph Végele AG (“Végele”) of Ludwigshafen, Germany; Wirtgen Group Holding GmbH
`
`(“Wirtgen Group”) of Windhagen, Germany; and Wirtgen America,Inc. (“Wirtgen America’) of
`
`' The *693patent, titled “Milling Machine with Re-Entering Back Wheels,” issued on November
`28, 2006. The ’693 patent generally relates to “work machines for the treatment of roadway
`surfaces, and moreparticularly to a planer or milling machine for asphalt and concrete.” See
`JX-1, °693 patent at 1:6-8.

`Antioch, Tennessee (collectively, “Wirtgen” or “Respondents”). See id. The Office of Unfair
`
`Import Investigations is not a party to this investigation.
`
`Seeid.
`
`The administrative law judge (“ALJ”) terminated the ’871 patent from the investigation
`
`after the ALJ found the asserted claimsofthat patent to be invalid under 35 U.S.C. § 101 as
`
`directed to ineligible subject matter. See Order No. 18 (May 24, 2018), aff'd, Comm’n Notice
`
`(June 27, 2019). The ALJ also terminated the °419 patent from the investigation after
`
`Caterpillar withdrew its allegations with respect to that patent. See Order No. 26 (July 5, 2018),
`
`unreviewed, Comm’n Notice (July 25, 2018). Claim 25 of the ’693 patent was also terminated
`
`from the investigation based on withdrawal ofallegationsas to this claim. See Order No: 38
`
`(Oct. 16, 2018), unreviewed, Comm’n Notice (Nov. 9, 2018).
`
`The ALJ conducted an evidentiary hearing on September 25 and 26, 2018, and on
`
`February 14, 2019, she issued her final initial determination (“FID”) finding a violation of
`
`section 337. Specifically, the FID finds that:
`
`(1) certain accused products, namely the Wirtgen
`
`W 100 CFi, W 120 CFi, and W 130 CFi road milling machines(collectively,“the series 1810
`
`machines”), infringe the asserted claims of the 693 patent, but anolder series of milling
`
`machines, namely, the series 1310 machines, do not infringe the patent; (2) all of the asserted
`
`claims, except claim 19 ofthe ’693 patent, are invalid as anticipated and/or obvious overcertain
`
`asserted priorart; and (3) the domestic industry requirementis satisfied by Complainants’
`
`PM3XX domestic industry products.
`
`On April 12, 2019, the Commission issued a notice determining to review the FID in part.
`
`See 84 Fed. Reg. 16282-83 (Apr. 18, 2019), On June 27, 2019, the Commission issued a final
`
`determination finding a section 337 violation (“Comm’n Op.”). See also Comm’n Notice, 84
`
`Fed. Reg. 31910-11 (July 3, 2019). Specifically, the Commission determined to affirm with
`
`
`

`modification the FID’s finding of a section 337 violation with respect to claim 19 of the 693
`
`patent. Seeid.
`
`In addition, the Commission affirmed with modification the FID’s findings
`
`with respect to the validity of claim 19 over the Volpe SF-100 T4 machine (RX-802)? in view of
`
`U.S. Patent No. 3,633,292 (Ulrich) (RX-946) and WO 97/42377 (Busley) (RX-950).
`
`Seeid.
`
`Furthermore, the Commission issued a limited exclusion order (“LEO”) against Wirtgen GmbH,
`
`Wirtgen Group, and Wirtgen America, and a cease and desist order (“CDO”) against Wirtgen
`
`America.? See id. The Commission determined that the public interest does not preclude the
`
`issuance of the LEO and CDOandset the bond during the period of Presidential review at zero
`
`percent of the entered value ofthe infringing products.
`
`Seeid.
`
`On August 9, 2019, Wirtgen filed a motion requesting that the Commission stay the
`
`remedial orders pending appealbefore the Federal Circuit.4 On August 19, 2019, Caterpillar
`
`filed a response in opposition to Wirtgen’s motion to stay.° On August 27, 2019, Wirtgen filed
`
`a motion to stay with the Federal Circuit. The appeal was docketed on August 28, 2019 sub
`
`nom. Wirtgen GmbHv. Int’l Trade Comm’n, No. 19-2320 (Fed. Cir. Aug. 28, 2019). On August
`
`30, 2019, the Federal Circuit issued an ordersetting the date for the Commission’s response to
`
`Wirtgen’s motion to stay to September6, 2019.
`

`
`LEGAL STANDARDS
`
`The Federal Circuit applies a four-part test for determining whether to stay a lower
`
`court’s remedy pending appeal:
`
`(1) whetherthe stay applicant has made a strong showingthat heis
`likely to succeed on the merits; (2) whether the applicant will be
`irreparably injured absent a stay; (3) whether issuance of the stay
`will
`substantially injure the other parties
`interested in the
`proceeding; and (4) where the public interestlies.
`
`Standard Havens Prods., Inc. v. Gencor Indus, Inc., 897 F.2d 511, 512 (Fed. Cir. 1990)
`
`(quotation omitted).
`
`The Commission considers motions for stay under the Standard Havens test exceptthat
`
`“an admittedly difficult legal question” test may be substituted for likelihood of successin the
`
`appropriate circumstances. Certain Agricultural Tractors Under 50 Power Take-Off
`
`Horsepower, Inv. No. 337-TA-380, Comm’n Op.at 10 (Apr. 25, 1997) (“Agricultural
`
`Tractors”); see also Washington Metro. Area Transit Comm. v. Holiday Tours, Inc., 559 F.2d
`
`841, 844 (D.C. Cir. 1977) (“Prior recourse to the initial decisionmaker would hardly be required
`
`as a general matter if it could properly grant interim relief only on a prediction that it has
`
`rendered an erroneous decision.”). Accordingly, a stay may be appropriate when the agency has
`
`“ruled on an admittedly difficult legal question and when the equities of the case suggest that the
`
`status quo should be maintained.” Jd. at 844-45; see also Agricultural Tractors, Comm’n Op.at
`
`10.
`

`
`DISCUSSION
`
`Having considered the parties’ submissions concerning a stay, as well as the underlying
`
`record of the Commission investigation, the Commission has determined to deny the motion for
`
`stay.
`
`In particular, the Commission finds that Wirtgen’s argumentsfall short for all four factors.
`

`Forthefirst factor of the above-referenced test, Wirtgen contests the Commission’s
`
`determination that Caterpillar satisfied the domestic industry requirement. Wirtgen arguesthat a
`
`complainant must show not merely that there are protectedarticles, but that the articles are
`
`available for commercial sale. Wirtgen’s Mot. at 7-8. Neither the text of section 337 norits
`
`legislative history supports Wirtgen. Nor has the Commissionever interpreted section 337 in
`
`that manner.® Asto validity, Wirtgen has failed to demonstrate the absence of substantial
`
`evidence supporting the Commission’s validity findings pursuant to the applicable appellate
`
`standard of review. Moreover, Wirtgen’s argumentthat institution of an interpartes review
`
`proceeding by the Patent Trial and Appeal Board providessufficient cause to warrant a stay is
`
`without merit; such institution requires a lower standard of proof than the clear and convincing
`
`burden that Wirtgen failed to satisfy in this investigation.
`
`Second, the Commission finds that Wirtgen has failed to demonstrate cognizable
`
`irreparable harm. Wirtgen has other milling machines, not impacted by the LEO and CDO,that
`
`it can continueto sell in the United States. These machines include Wirtgen’s W 150 CFi
`
`compact-size milling machine as well as its small and large size milling machines. See
`
`Caterpillar Opp’n at 17. See also Arista Networks, Inc. v. Int'l Trade Comm'n, Docket Nos.
`
`2017-2289, -2351 (Fed. Cir. Sept. 22, 2017) (denying motionto stay, “subject to the condition
`
`that the product redesign on which Ciscorelies to deny irreparable harm must be permitted to
`

`impression relating to the Commission’s authority with respect to electronic transmissions and
`whether such electronic transmissionsare “articles” within the meaning of section 337.
`Seeid.
`at 2,6. The present investigation raises no such questionsoffirst impression, and merely
`challenges, without legal support, the Commission’s longstanding application of section 337.
`

`enter the country”).
`
`In addition to these machines, the Commission explicitly carved out from
`
`the remedial orders Wirtgen’s series 1310 machines, which were foundnotto infringe claim 19
`
`of the ’693 patent. See Comm’n Op. at 47. Furthermore, as for lost part sales alleged to cause
`
`Wirtgen harm, the remedial orders contain a provision exempting components that are used in
`
`servicing or repairing infringing road construction machinesthatare already in the possession of
`
`consumers.’ See id. at 49-50 Thus, the continuedavailability of these Wirtgen road
`
`construction machines and service components for machinesin the hands of existing Wirtgen
`
`customers, as well as the potential availability of a redesign,® undermines Wirtgen’s goodwill
`
`claim that its U.S. customers “will lose familiarity with Wirtgen machines.” Wirtgen’s Mot.at
`
`20. Finally, Wirtgen has not shown thatits desire to continue selling infringing merchandiseis
`
`any different from all other adjudged infringers that standto lose sales to the patent holder’s
`
`competing products.
`
`Asto the third factor, Wirtgen has failed to demonstrate that the balance of harmstips in
`
`its favor. The Commissionfinds that a stay of the remedial orders during appeal would
`
`substantially harm Caterpillar because it would be deprived ofthe only relief available under
`
`section 337 during the pendency of the appeal. See Certain High-Brightness Light Emitting
`
`Diodes and Products Containing Same, Inv. No. 337-TA-556, Comm’n Op.at 12 (Sept. 11,
`
`7 Commissioner Schmidtlein did not join the Commission majority’s decision to grant the
`exemption to the remedial orders for the importation of service and repair components. See
`Comm’n Op. at 48, n.51. The inclusion of the exemption in the remedial orders does not impact
`her decision in the pending matter. She supports denying Wirtgen’s motion even without
`considering the exemption.
`® Wirtgenstatesthatit “is attempting to bring to market a redesign that would notbe subject to
`the Commission’s exclusion order.” Wirtgen’s Mot. at 19 n.1. The Commission notes that
`there are procedures available under Commission Rules 210.76 and 210.79 through which
`Wirtgen mayobtain a timely ruling regarding whetherits redesign falls within the scope of the
`remedial order. See 19 C.F.R. §§ 210.76, 210.79. Thusthe potential future availability of an
`approvedredesign further diminishes any commercial harm Wirtgen alleges in its motion.

`2007) (“[A] stay pending appeal prejudices the complainant by deprivingit, in this case
`
`potentially for a year or more, of the relief to whichit is statutorily entitled under section 337.”)
`
`(citing Certain Agricultural Tractors, Comm’n Op. at 16). The complete deprivation of any
`
`relief to the injured complainant here outweighs Wirtgen’s weak showingofalleged harm,
`
`particularly given Wirtgen’s continued ability to sell non-infringing road construction machines
`
`and certain components in the United States.
`
`Asto the fourth factor, the public interest also weighs against granting Wirtgen’s motion
`
`to stay. The Commission agrees with Caterpillar that customers will be adequately served by
`
`the many milling machinesstill on the market, including Wirtgen’s own milling machines that
`
`are not covered by the LEO,as well as machines supplied by Caterpillar, Roadtec Inc., and
`
`Bomag Americas Inc. See Caterpillar’s Opp’n at 17, 19-20; see also Inv. No. 337-TA-1088,
`
`Comm’n Op.at 56; id. at 54-57 (finding the public interest factors do not preclude the issuance
`
`of the LEO and CDO in this investigation).
`
`For the foregoing reasons,it is hereby ORDEREDthat:

` Wirtgen’s motion for a stay of the Commission’s remedial orders pending appeal

`is DENIED;
