`Defendant Seagen Inc. (“Seagen”) moves the Court for an Order, substantially similar to
`

`the proposed order attached hereto, to stay this action in accordance with the “first-to-file” rule.
`
`In the alternative, Seagan moves to dismiss this action under Rule 12 of the Federal Rules
`
`of Civil Procedure, in accordance with the Declaratory Judgment Act, 28 U.S.C. §§ 2201 and
`
`2202, and/or Fed. R. Civ. P. 12(b)(6).
`
`Absent a stay or dismissal of the entire case, Seagen moves to dismiss AstraZeneca
`
`Pharmaceuticals LP due to lack of subject matter jurisdiction under Fed. R. Civ. P. 12(b)(1).
`
`The grounds for this motion are set forth in Seagen’s Opening Brief and the Declaration
`
`of Pieter S. de Ganon, filed contemporaneously herewith.
