`regarding the action pending in the Eastern District of Texas1, including their positions as to

`whether the current stay (expiring February 4, 2022) should be extended and/or how this case

`should proceed.

`Fact and expert discovery are complete in the Texas case, the parties are briefing
`
`dispositive motions and motions to strike expert testimony, and the parties have begun pretrial
`
`disclosures. See Ex. A (11/16/21 First Amended Docket Control Order). A jury trial before
`
`Judge Gilstrap is scheduled to begin on April 4, 2022. Id.
`
`
`
`In light of the foregoing, the parties respectfully submit that the stay of this action, which
`
`currently expires on February 4, 2022, should be extended another 90 days to permit the parties
`
`to reach mutual agreement as to (1) how to address Claims 6-8 of the ’039 patent, which
`
`do not overlap between the Texas action and this action and (2) whether the stay should be
`
`extended until the final adjudication of or dismissal of the Texas case.
`
