`
`Having carefully reviewed Netflix, Inc.’s Motion for Summary Judgment of
`
`Invalidity Under 35 U.S.C. § 101 and the related briefing (D.I. 350, 351, 360, 361, 362, 363, 381,
`
`382, 385, 386, 403, 405, 409), the parties are advised that the Court is inclined to grant summary
`
`judgment of invalidity of the asserted claims under 35 U.S.C. § 101.
`
`2.
`
`In the interests of efficiency and economy, IT HEREBY ORDERED that:
`
`a. The jury trial scheduled to begin on March 3, 2025, is CONTINUED, as are all
`
`deadlines pertaining to pretrial submissions;
`
`b. The February 21, 2025 Pre-trial Conference is converted to an oral argument
`
`on Netflix’s Motion for Summary Judgment of Invalidity Under 35 U.S.C.
`
`§ 101 (D.I. 350);1
`
`c. On or before February 14, 2025, each side shall file a letter identifying (in list
`
`format without argument) the three most analogous § 101 cases, see Enfish,
`
`

`LLC v. Microsoft Corp., 822 F.3d 1327, 1334 (Fed. Cir. 2016) (“[B]oth this
`
`court and the Supreme Court have found it sufficient to compare the claims at
`
`issue to those claims already found to be directed to an abstract idea in previous
`
`cases.”); and
`
`d. On or before February 14, 2025, the parties shall meet and confer to discuss the
`
`following: (1) whether the parties can agree to resolve this case without further
`
`proceedings; and (2) if the parties cannot resolve the case, and assuming the
`
`Court grants summary judgment of invalidity under 35 U.S.C. § 101, what
`
`remaining proceedings must occur before final judgment may be entered. The
`
`parties shall be prepared to update the Court on both issues at the February 21,
`
`2025 hearing.
