`Duty to Avoid Unnecessary Expenses of Serving a Summons
`Rule 4 ofthe Federal Rules ofCivil Procedure requires certain defendants to cooperate in saving unnecessary expensesofserving a summons
`and complaint. A defendant whoislocated in the United States and whofails to return a signed waiver of service requested byaplaintiff located in
`the United States will be required to pay the expensesofservice, unless the defendant shows good causeforthe failure.
`“Good cause” does notinclude a beliefthat the lawsuit is groundless,orthatit has been broughtin an improper venue,orthat the court has
`no jurisdiction over this matter or over the defendantor the defendant's property.
`Ifthe waiver is signed and returned, you can still make these andall other defenses and objections, but you cannot object to the absence of
`a summonsorofservice.
