`Pursuant to Federal Rule of Civil Procedure 12(b)(6) and 35 U.S.C. § 101,

`Defendant Pinterest, Inc. (“Pinterest”) respectfully moves to dismiss Counts I, II,
`
`and III of Plaintiff OpenTV, Inc.’s First Amended Complaint (D.I. 16) with
`
`prejudice on the grounds that U.S. Patent Nos. 10,419,817, 9,699,503 and 7,669,212
`
`fail to recite patent eligible subject matter under 35 U.S.C. § 101.1
`
`The full grounds for this motion are set forth in Pinterest’s Opening Brief filed
`
`contemporaneously herewith.
`
`
`Pinterest reserves its right to move, following claim construction, to dismiss

`Count IV of the First Amended Complaint on the grounds that U.S. Patent No.
`7,055,169 fails to recite patent eligible subject matter under 35 U.S.C. § 101.
