`This advancement action is hereby reassigned to Magistrate Judge Gibbs.

`The procedure for payment of advancement and fees on fees reflected in my

`September 28, 2023, order remains in place. The parties shall submit a proposed
`
`implementing order regarding my October 3, 2023, oral ruling without delay.
`
`The Magistrate will preside over this action until a final resolution. To
`
`streamline the proceedings, the parties should strongly consider agreeing to submit
`
`this matter to the Magistrate for a final adjudication that shall not be subject to
`
`further judicial review in accordance with Rule 144(g). The parties may so stipulate
`
`using the following language, filed in a Stipulation And Proposed Order For Final
`
`Resolution By The Magistrate In Chancery:
`
`The parties hereby agree to submit this action to a
`Magistrate in Chancery for a final decision under 10 Del.
`C. § 350 and Court of Chancery Rule 144(g). The parties
`hereby waive the right to seek judicial review of the
`Magistrate in Chancery’s decision at the trial court level
`

`and agree that the Magistrate in Chancery’s final decision
`will constitute a decision of the Court of Chancery. The
`parties hereby confirm their understanding that any
`appeal from the decision will be subject to the same
`procedural and substantive standards as are applicable to
`appeals from decisions of the Chancellor or a Vice
`Chancellor.
