`Myattorney has discussed the contents of this plea agreement with me, including the fact
`that I may request or waive DNAtesting. I have been advised by the Court and my attorney that
`the government
`is in possession of physical evidence that was seized or recovered in the
`investigation or prosecution ofthis case, and that some of this evidence may containbiological
`material. I understandthat before entering a guilty plea or proceeding totrial, | may have the right
`to request independent DNAtesting of that biological material, ifa sufficient quantity of material
`exists.
`I also understand that J may waivethatright and give up the chance to have an independent
`DNAtest performed.

`I understand that certain pieces of evidence in this case were sent for DNA testing.
`Specifically, I understand that the government conducted DNAtesting on swabs from the Nissan
`Altima used in the shooting of D.H. and Darryl Holton. The report detailing the results has been
`provided to me and myattorney for review. I further understandthat no interpretable DNAprofiles
`resulted from the DNAtesting of these swabs.

`I know that I may request independent DNAtesting of the evidence obtained from the
`victim, crime scene, or me.
`I have discussed the significance of DNAtesting with my attorney
`and I am satisfied with my attorney’s explanation of DNA evidence and how it may be used at
`trial.
`I understand that I may request independent DNAtesting of evidence containing biological
`material in this case andthat if I waive, or give up, independent DNAtesting atthis timeit is likely
`that
`I will never have another opportunity to have the evidence in this case submitted for
`independent DNAtesting.

`DNAtesting of any evidence containing biological material in this case.
