`Dear Mr. Miedema:

`This letter is to request your assistance as a cooperating agency in the Federal
`Energy Regulatory Commission’s (FERC or Commission) development of an
`environmental assessment (EA) for the above-referenced project, which previously
`received a Certificate of Public Convenience and Necessity from the Commission on
`March 24, 2004 in Docket Nos. CP01-409-000, et al. Calypso U.S. Pipeline, LLC
`(Calypso) has now proposed modifications to its original proposal, and those
`modifications will be reviewed by the Commission. As certificated, the project would
`involve the construction of an approximately 42.5-mile-long, 24-inch-diameter natural
`gas pipeline from a receipt point on the Exclusive Economic Zone (EEZ) boundary
`between the United States and the Bahamas to an interconnect with the existing Florida
`Gas Transmission System pipeline at the Florida Power and Light Fort Lauderdale Power
`Plant in Broward County, Florida. Calypso’s proposed modifications reflect the
`incorporation of tunnel construction methodology for the nearshore portion of the
`pipeline, as well as certain other design changes.
`
`We will prepare an EA to evaluate the impacts of Calypso’s proposed project
`modifications as required by NEPA. This EA will be used by the Commission in its
`decision-making process to determine whether the proposed project modifications are in
`the public convenience and necessity. We recognize that the U.S. Environmental
`Protection Agency (EPA) has special expertise with respect to environmental issues

`associated with the project and invite your participation in determining the potentially
`affected resources, fully evaluating the impacts, and developing appropriate alternatives
`and impact minimization strategies. It is our goal to prepare an EA that can be used by
`the FERC and EPA to satisfy our respective NEPA and/or permitting responsibilities.

`as a cooperating agency will allow us to:

`communicate informally throughout the process to identify and resolve
`environmental issues early in the review process;
`attempt to build a consensus on appropriate methods to avoid or minimize
