`and conditions of the WSPP Agreement and Service Schedule C, as amended and effective as of July
`1, 2000 (“*Agreement"”) and those additional terms and conditions provided for in Special Provisions

`1. Seller shall deliver energy to Buyer and Buyer shall take receng;of/energy from Seller at either of
`two Delivery Points (Garrison or Hot Springs), with the exact delivery point determined by Seller
`no later than 8:00 a.m. PPT on the first Business Day precedlng the day of delivery.

`2. Unless prevented by Uncontrollable Forces as defined In Section 10 of the Agreement, any
`failure to deliver or receiye the Quantity of energy, as indicated above, shall subject the Non
`Performing Party to payment of Damages, if any, as ldentifled in Saction 21 of the WSPP
`

`Upon receipt of this Confirmation Agreement, Buyer shall notify PPL Montana, LLC of Its appmval
`- within two (2) business days. Buyer shall return the Confirmation Agreement by fax, to (406) 533-
`- 0208, Both the Buyer and PPL Montana, LLC agree that this written Confirmation Agreement is tha
`final verification of the verbal agreement describad above, unless the Buyer notifies PPL Montana,
`LLC in writing within two (2) business days following the recelpt of this Conflrmation Agreement.

`1. Seller shall deliver energy to Buyer and Buyer shall take recsipt of energy from Seller at either of
`two Delivery Points (Gartison or Hot Springs), with the exact transmission path and delivery
`point to be determined by Seller ho later than 8:00 a.m. PPT on the first Business Day preceding '
`the day of delivery. ' :

`2. Unless prevented by Uncontrollable Forces as defined in Section 10 of the Agreement, any
`fallure to deliver or receive the Quantity of energy, @s Indicated above, shall subject the Non
`Performing Party to payment of Damages, if any, as identified in Section 21 of the W5PP
