`SYSTEM ENERGY RESOURCES, INC.’S STATUS REPORT CONCERNING THE
`MISSISSIPPI PUBLIC SERVICE COMMISSION’S DOCKET NO. ER23-1164
`PROTEST
`
`Consistent with its commitment to provide an update to the Commission regarding this
`
`matter,1 System Energy Resources, Inc. (“SERI”) files this report concerning the Mississippi
`
`Public Service Commission’s (“Mississippi Commission”) March 15, 2023 Protest to SERI’s
`
`February 22, 2023 compliance eTariff filing filed in Docket No. ER23-1164. On September 12,
`
`2024, in lead docket number ER18-1182, SERI filed with the Commission a global settlement
`
`with the Louisiana Public Service Commission (“LPSC”) to resolve twenty dockets, including
`
`Docket No. ER23-1164. SERI explained that the Mississippi Commission had protested SERI’s
`
`compliance eTariff filing in Docket No. ER23-1164 (one of the settlement dockets), and
`
`committed to provide an update to the Commission regarding attempts to resolve the dispute. In
`
`this report, SERI provides an update and proposes a procedural path forward concerning the
`
`pending SERI-LPSC settlement and the pending designated power purchase agreement in
`
`Docket No. ER25-98.
`
`Status of Docket No. ER23-1164: SERI reports that it and the Mississippi Commission
`
`are still productively engaged in efforts to amicably resolve the dispute raised in the Mississippi
`
`Commission’s ER23-1164 Protest. At this time, they do not expect resolution prior to the end of
`
`2024. SERI commits to provide an additional update to the Commission within sixty days.
`
`SERI-LPSC Settlement Impact: SERI’s settlement with the LPSC was filed on
`
`September 12, 2024 in lead docket number ER18-1182-010. No protests or objections were filed
`
`in response to the settlement. As previously noted, the LPSC has taken no position on SERI and
`
`
`Sys. Energy Res., Inc., FERC Docket No. ER18-1182-010, Transmittal Letter at 3 (filed Sept. 12,
`

`the MPSC’s dispute in Docket No. ER23-1164. As a result, SERI believes that if the
`
`Commission finds the settlement to be in the public interest, then it may approve the SERI-LPSC
`
`settlement and terminate all dockets except for Docket No. ER23-1164.
`
`MSS-4 Replacement Tariff PPA (ER25-98): Pursuant to the SERI-LPSC settlement,
`
`on October 15, 2024, Entergy Louisiana, LLC and Entergy Mississippi, LLC also submitted in
`
`Docket No. ER25-98 a designated power purchase agreement (PPA) for Commission review and
`
`acceptance, which is subject to necessary regulatory approvals. Entergy Louisiana and Entergy
`
`Mississippi are requesting that the PPA become effective January 1, 2025. No party has
`
`protested or objected to the proposed PPA. Out of abundance of caution, SERI confirms that the
`
`Mississippi Commission’s protest in Docket No. ER23-1164 does not have any effect on the
`
`proposed PPA.
`
`Conclusion: Given the non-opposition to the SERI-LPSC settlement (Lead Docket No.
`
`ER11-1182-010) and the non-opposition to the MSS-4 Replacement Tariff PPA (Docket No.
`
`ER25-98), SERI respectfully requests that the Commission issue orders no later than December
`
`15, 2024 that:
`
`(1) Approve the SERI-LPSC settlement and terminate all settled dockets except for
`
`Docket No. ER23-1164;
`
`(2) Approve the MSS-4 Replacement Tariff PPA between Entergy Louisiana and Entergy
`
`Mississippi.
`
`SERI commits to further update the Commission regarding the dispute in Docket No. ER23-1164
`
`within 60 days of this filing. SERI is authorized to state that the Mississippi Commission
`
`concurs with this status report. Additionally, once SERI and the Mississippi Commission reach a
`

`conclusion to their discussions concerning Docket No. ER23-1164, SERI commits to provide a
`
`recommendation to the Commission about the administrative resolution of that remaining docket.
