`Basis for Intervening:
`Big Flat Electric Co-op., Inc. ( BFEC ) respectfully moves to intervene in
`Docket No. ER20-1-000, in which Basin Electric Power Cooperative ( Basin
`Electric ) submits to the Federal Energy Regulatory Commission
`( Commission ) Basin Electric s market-based rate tariff ( MBR
`Tariff ) and asks that the Commission waive the minimum sixty-day and maximum
`120-day notice of filing requirement for the MBR Tariff; grant Basin Electric
`the authority to sell energy, capacity and ancillary services in wholesale
`transactions at market-based rates; grant waivers of, and authorizations under,
`certain of the Commission s regulations that are routinely accorded to
`entities with market-based rate authority; and determine that Basin Electric is
`a Category 2 Seller in the Northwest, Southwest Power Pool, Inc., and Central
`regions and a Category 1 Seller in all other regions. Basin Electric explains
`that it submits this filing because it will no longer qualify for an exemption
`from Commission regulation under the Federal Power Act on the earlier of the
`date on which: (1) it admits a Class A Member that does not qualify for such an
`exemption or (2) an existing Class A Member ceases to qualify for such an
`exemption.

`BFEC is a not-for-profit member-owned electric distribution cooperative serving
`northcentral to northeastern Montana. BFEC was established in 1946. Today, BFEC
`owns and operates approximately 66 miles of transmission lines and 3 related
`substations and over 1,563 miles of distribution lines, which are interconnected
`with the facilities of the Western Area Power Administration   Upper Great
`Plains Region ( WAPA-UGP ) and Basin Electric. In 2018, BFEC s sales
`totaled about 30,261 megawatt hours of electricity. BFEC is governed by a 7-
`member Board of Directors. BFEC is a Class C member of Basin Electric. BFEC is
`not a borrower under the United States Department of Agriculture s Rural
`Utilities Service program. Finally, because BFEC sells less than 4,000,000
`megawatt hours of electricity per year, it is not a  public utility  under
`section 201(e) of the FPA by virtue of section 201(f) of the FPA. 16 U.S.C. §§
`824(e) and 824(f).
`
`As a Member of Basin Electric, BFEC has a direct and substantial interest in the
`outcome of this proceeding that cannot be adequately represented by any other
`participant. Accordingly, BFEC respectfully requests that it be granted full
`party status in this proceeding.
