`and collectively, â(cid:128)(cid:156)Members â(cid:128)(cid:157)). Basin Electric explains that it submits this
`filing because it will no longer qualify for an exemption from Commission
`regulation under the Federal Power Act on the earlier of the date on which: (1)
`it admits a Class A Member that does not qualify for such an exemption or (2) an

`Power Contractsâ(cid:128)(cid:157)). Basin Electric explains that it makes this filing because
`it will no longer qualify for an exemption from Commission regulation under the
`Federal Power Act on the earlier of the date on which: (1) it admits a Class A
`Member that does not qualify for such an exemption or (2) an existing Class A
`Member ceases to qualify for such an exemption. Basin Electric requests waiver
`of the Commissionâ(cid:128)(cid:153)s notice requirements and asks that the Commission permit
`the Rate Schedules to go into effect on the date on which Basin Electric becomes
`subject to the Commissionâ(cid:128)(cid:153)s jurisdiction.

`borrower under the United States Department of Agricultureâ(cid:128)(cid:153)s Rural Utilities
`
`

`

`Service program. Because LyonLincoln sells less than 4,000,000 megawatt hours
`of electricity per year, it is not a â(cid:128)(cid:156)public utility â(cid:128)(cid:157) under section 201(e)
