`Basis for Intervening:
`Neptune Regional Transmission System, LLC ( Neptune ) respectfully moves to
`intervene in this proceeding. The Neptune Line is a High Voltage Direct Current
`( HVDC ) merchant transmission facility that is owned by Neptune and is
`under the operational control of PJM Interconnection, L.L.C. ( PJM ). The
`Neptune Line is interconnected to both PJM and the New York Independent System
`Operator, Inc. transmission systems. Neptune is a PJM Transmission Owner under
`the PJM Tariff. As a PJM Transmission Owner, Neptune pays the costs of PJM
`transmission facilities through Schedule 12 of the PJM Tariff, and the PJM
`Border Rate. Therefore, Neptune has a direct and substantial interest in the
`outcome of this proceeding, and stands to be directly affected by the outcome of
`this proceeding. Accordingly Neptune cannot be adequately represented by any
`other party in this proceeding and Neptune requests leave to intervene in this
`proceeding.
