`
`NOTICE GRANTING EXTENSION OF TIME
`
`(May 10, 2022)
`
`On May 3, 2022, participants in the above-captioned proceedings (Movants)1 filed
`a motion for an extension of time to file exceptions to the Partial Initial Decision (Parts 5-
`10) (Second Partial Initial Decision) issued on April 27, 2022.2 Under Rule 711(a) of the
`Commission’s Rules of Practice and Procedure,3 briefs on exceptions are currently due
`May 27, 2022, and briefs opposing exceptions are currently due June 16, 2022. Movants
`request that the dates for briefs on and opposing exceptions be extended to June 20 and
`August 1, 2022, respectively.
`
`1 Movants include BP Products North America, Inc.; Chevron Products Company;
`Metroplex Energy, Inc.; Phillips 66 Company; TPCU Inc.; Trafigura Trading LLC; Valero
`Marketing and Supply Company; American Airlines, Inc., Epsilon Trading, LLC;
`Southwest Airlines Co.; United Aviation Fuels Corporation; CITGO Petroleum
`Corporation; Saratoga RP East LLC; Gunvor USA LLC; Pilot Travel Centers LLC;
`Sheetz, Inc.; Apex Oil Company, Inc.; FutureFuel Chemical Company; Colonial Pipeline
`Company; and Commission Trial Staff.
`
`2 Epsilon Trading, LLC v. Colonial Pipeline Co., 179 FERC ¶ 63,008 (2022).
`Movants also request that the Chief Administrative Law Judge extend the page limits for
`briefs on and opposing exceptions. On May 4, 2022, the Deputy Chief Administrative
`Law Judge issued an order granting the request to extend the page limits and waived the
`answer period as to that request. Epsilon Trading, LLC v. Colonial Pipeline Co., Docket
`No. OR18-7-003, at 3 (May 4, 2022).
`
`3 18 C.F.R. § 385.711(a) (2021).
`
`
`
`Docket No. OR18-7-002, et al.
`
`3
`
`Movants state that additional time is needed because the Second Partial Initial
`Decision represents the first review of Colonial Pipeline Company’s cost-based index
`rates since the Commission adopted trended original cost ratemaking for oil pipelines in
`1985. Citing the extensive record to be addressed, Movants submit that extending the
`briefing deadlines under Rule 711(a) is reasonable to allow the participants to prepare
`briefs that will most effectively assist the Commission in its review of the Second Partial
`Initial Decision. Movants state that the motion was circulated to all participants and that
`no participant indicated opposition to the motion.
`
`Upon consideration, notice is hereby granted that Movants’ motion is granted and
`the filing dates are hereby extended to and including June 20, 2022, for briefs on
`exceptions, and extended to and including August 1, 2022, for briefs opposing
`exceptions.
`

`Deputy Secretary.
