`It is the ongoing responsibility of a Licensee or Exemptee to ensure that a project
`is operated and maintained in compliance with Federal Energy Regulatory Commission
`{(FERC) Regulations and the terms and conditions of any license or exemption, including
`conditions preseribed by resource agencies for exemptions.
`
`To assist you in ensuring compliance with these requirements, enclosed is a
`summary of some of the requirements, pnimarily from Parts & and 12 of Commission
`Regulations. Please review these requirements along with your project-specific license or
`exemption conditions, to ensure that your operations comply with all project
`requirements.
`
`Your strict attention is directed to Item 1 of Enclosure 1. It is imperative that we
`be notified immediately of any condition affecting the safety of a project. You have a
`clear and serious responsibility to recognize any such condition and report it to us. If you
`are unclear if an emerging, ongoing, or completed event constitutes a condition affecting
`the safety of a project, you should contact this office.
`
`Throughout the year, the Division of Dam Safety and Inspections hosts workshops
`and training courses which may be of interest to you. A schedule and description of
`upcoming workshops and courses can be accessed at the following internet site:
`

`The Annual Spillway Gate Operation Certificate (Attachment 1 of Enclosure 1)
`has been modified this year to include the classification of each gate (category 1 or 2),
`and the date of the last detailed inspection (required every 10 years) for category 1 gates.
`Please ensure that this new form is used in future submittals.
`
`Enclosure 2 lists some administrative requirements that are often not adhered to.
`Enclosure 3 is an acknowledgement form. Please review Enclosure 2 for needed

`The following requirements and Commission Regulations (Title 18 of the Code of
`Federal Regulations [ 18CFR]) require the attention of Licensees and Exemptees 1o ensure
`compliance. This list is not intended to be complete and certain requirements may not be
`applicable to all projects. Therefore, each Licensee and Exemptee must be familiar with
`thetr specific license or exemption requirements and the requirements contained in 138
`CFR Part 12. You should periodically review the license/exemption and the current
`regulations to ensure timely compliance with all requirements, since
`Licensees/Exemptees have continuing responsibilities, such as consultation and proof of
`SErVICE.
`
`1. Notify FERC of Conditions Affecting the Safety of 8 or Project Works,
`In accordance with Section 12.10{a) of the FERC Regulations, when a condition affecting
`the safety of a project or project works is discovered, a Licensee/ Exemptee must call this
`office as soon as practicable and subsequently submit a written report providing relevant
`information concemning the cause, extent of project and property damage, and measures
`taken to prevent worsening of the condition. Sece Section 12.3(b)(4), which lists some
`examples of these conditions. Such conditions may include, but are not limited to, gate
`operation failure, piping, seepage, slides, unusual instrumentation readings, sinkholes,
`sabotage, natural disasters (floods, earthquakes), and any other signs of instability of any
`project works. Additional conditions include, but are not limited to, reservoir monitonng
`instrumentation and communication systems malfunction or failure, and remote control
`systems malfunction or failure.
`
`2. Report Emergency Project Modifications. In accordance with Section 12,11 (b)
`(1), any emergency project modification taken in response to a condition affecting the
`
`safety of the project or project works must be reported to this office immediately,
`
`3. Submit Plans for FERC Approval. In accordance with Section 12.11 (b} (2), all
`
`plans for proposed modifications or major maintenance work must be forwarded to this
`office at the earliest possible date, but not later than 60 days before work on the activity
`begins, so that determinations can be made regarding any necessary preconstruction
`approvals. Prior approval may also be required for modification or maintenance
`activities that may adversely affect project operation or the environment. You must
`contact (e.g. phone call, letter) this office concerning required approval of these types of
`activities at least 30 days prior to the start of the proposed activity.
`

`a, Pursuant to Sections 12.4, 12.42, and 12.43, an owner may be required to install
`and properly maintain any signs, lights, sirens, barriers, or other safety devices
`
`

`necessary to adequately wamn and/or protect the public in use of project lands and
`waters. Failure to adequately maintain approved safety devices or measures is a
`violation of the Regulations.
`
`b. Some Licensees/Exemptees have been required to provide Public Safety Plans
`for each development where public safety devices or measures are necessary.
`Updated plans should be provided following any changes to public safety facilities
`or measures at the project.
`
`c. A Licensee/Exemptee must notify this office at least 10 days in advance of
`plans to remove any public safety device, including boat safety barriers. This office
`should also be advised when the device is placed back in service. For those devices
`routinely removed annually, a one-time notification providing the reason and
`schedule for periodic removal and reinstallation is acceptable.
`
`5 Re Deaths and ous ries. In accordance with Section 12.10 (b), any
`drowning or accident resulting in death or serious injury to the public or construction and
`maintenance workers at the project must be reported to this office. If project related, the
`initial report should be by telephone promptly upon becoming aware of such an incident.
`The telephone report should be followed by a written report that fully describes the
`incident and any remedial actions taken or proposed to aveid or reduce the chance of
`future similar occurrences. If you believe that remedial actions are unnecessary, the
`report should explain why. If the accident was not project related, the subsequent written
`report may be conveyed by providing a copy of a newspaper article or a police report.
`
`6. Deve Maintain Report on Eme: ction Plan.
`
`a. If your project has been exemptied from filing an EAP, three copies of a letter
`should be submitted to this office by December 31 of each year that documents any
`
`changes to the upstream and downstream development, verifies that no reasonably
`foreseeable project emergency would endanger life, health, or property, and requests
`that the exemption be continued (if this action is supported by your review).
`
`b. If your project requires an EAP, the following conditions apply as part of your
`annual review required by Subpart C of 18 CFR 12:
`
`i. Annually test the EAP to assure the accuracy and workability of the
`document and to test the state of training of key licensee personnel
`responsible for responding to emergencies.
`
`il. Ensure that an up-to-date EAP notification list is posted in a
`prominent location at each development, readily accessible to
`
`

`operating personnel responsible for notification. The EAP
`Notification Flowchart and other appropriate sections should
`indicate the primary and secondary FERC contacts, which are the
`Regional Engineer and the Deputy Regional Engineer.
`
`iii. An annual, face-to-face meeting with emergency response agencies
`who have a role and responsibility in implementation of the EAP is
`critical and mandatory., These meetings must include a review of the
`contents of the EAP, and should encourage agency input into the
`development and maintenance of the EAP document.
`
`fv. Within 30 days of the annual EAP test, submit a report confirming
`adequate training and readiness of key personnel, including a test
`critique, an evaluation of the time required to complete the test, and
`identification of improvements made to shorten implementation
`time. This office must be contacted at the time of your test as part of
`the notification process.
`
`v. An annual report is due no later than December 31, of each year. If
`you cannot meet this deadline, you should submit a justified
`extension request as soon as possible. Annual updates to the EAP
`required by Section 12.24 should consider the following items:
`
`1. Update names and titles of project operators and attendants
`and the names and telephone number of persons to be
`contacted in the event of a project emergency.
`
`2. Review the EAPs adequacy in light of any significant changes
`in upstream or downstream circumstances that might impact
`persons or property in a project emergency.
`
`3. Revise inundation maps, if necessary.
`
`4. Ifrequired or otherwise as appropriate, revise the EAP after
`consultation and cooperation with the appropriate Federal,
`state, and local agencies responsible for public health and
`safety.
`
`For security reasons, it is important to limit sensitive information provided to the
`public and to tightly control distribution of certain information. For EAPs, this includes
`any technical information such as engineening details (text and drawings), specific to the
`dam, potential modes of failure, facility details, etc. Licensees should make efforts to
`

`control such information. This can be done by keeping specific engineering details in
`some controlled EAP copies (such as those retained at the dam and submitted to the
`Commission), while removing such details from copies distributed to outside agencies
`that have no specific need for the information.
`
`7. Test n Spillway Ga ra
`
`a. Section 12.44 (b) requires annual operation of cach spillway gate either during
`regular project operation or on a test basis. If it is not feasible to operate each of the
`gates at the time of the FERC inspection, verification [see Item 7 (c) below] that the
`gates were operated satisfactorily during the past 12 months will suffice.
`
`b. A FERC inspector may require operation of a spillway gate, including the use
`of standby power, during an inspection.
`
`¢. Notarized verification of operation of all spillway gates and load testing of
`standby power at least once during the preceding 12-month period should be
`submitted by December 31 of each year. Verification should be in accordance with
`Section 12.13 and include the signatures of an official of your company and the
`plant personnel who actually operated the gates and observed such operation. You
`must also include an annual spillway gate operation certification (Attachment 1 to
`Enclosure 1) indicating those gates opened during flood flow conditions, those
`tested separately, the date of each gate’s operation, and the date of the last full gate
`operation. The report should address any maintenance performed.
`
`d. All gates, with the exception of Category 2 Tainter gates, must be tested to full
`gate opening at least once every 5 years. If such a test is not considered feasible, a
`waiver, with appropnate justification, must be obtained from this office. Category 2
`Tainter gates require full opening at least once every 10 years.
`
`8. Document Project Flows and Report Violations. During FERC operation
`inspections, your daily records documenting compliance with project minimum flow
`
`and/or reservoir operation plan requirements must be made available for our review if
`your license or exemption includes such requirements. These should include your
`records for the water year(s) since the last FERC Operation Inspection, all data for the
`current year published or otherwise available from the U.S. Geological Survey, or written
`certification of your compliance.
`
`In the event that such records are not current, or if they were not reviewed by FERC
`staff during an inspection of your project, we request that you provide a statement, signed
`by a senior operations official confirming that the minimum flow and/or reservoir
`operation plan requirements have been adhered to.
`

`If a minimum flow or reservoir operation plan requirement is violated, you must
`immediately report the occurrence to the following:
`

`Also, send a copy to this office (San Francisco Regional Office). This report should
`include a complete description of the violation, including duration, and an explanation of
`the actions taken to remedy the situation.
`
`9. Post Recreation Signs. Part 8 requires, where appropriate, the posting of project
`lands as to their availability for recreational use.
`
`10. Maintain Project Records. Section 12.12 requires that certain permanent project
`records be maintained. Copies of design drawings (Exhibit F or L), instrumentation data,
`and operational history should be maintained at the project site.
`
`11. Install Performance Monitoring Instrumentation. Section 12.41 addresses the
`
`requirement for installation of mstrumentation to monitor the performance of project
`structures.
`
`12. Prevent Erosion and Air/Water Pollution. Under the terms of any license issued
`by the Commission, licensees are responsible for preventing soil erosion, sedimentation,
`and any form of water or air pollution. Release of hazardous liquids (oils, grease, efc.) is
`under the jurisdiction of state water quality agencics and the EPA, and the project
`operators should be aware of the requirements of those agencies. Other potential sources
`of hazardous materials, in addition to those sources directly related to the project
`{transformer, governor, and lubricating oils), include public marinas and private boat
`docks. While licensees may not have direct responsibility for the operation of such
`facilities you should assist or otherwise facilitate in minimizing the introduction of
`pollutants into project waters and advise such operators to promptly report spill incidents
`to appropriate state and Federal agencies and this office. You should review your current
`practices regarding the storage, use, and disposal of hazardous materials to determine if
`additional control measures are necessary.
`
`A ve Pro or Project Features. Under Section 10 (c) of the Federal
`Power Act, project works must be maintained in a good state of repair. Any project or
`feature of a project that is inoperative, or in a poor state of repair, must be promptly
`

`reported to this office. A plan and schedule for restoring the project back to a sound
`state of repair or operation must also be submitted.
`
`14. oir Drawdown Dewateri f Project F res.
`
`a. Reservoir Drawdown. Under Section 12.4(b), prior approval for any non-
`emergency reservoir, canal, or forebay drawdown activities outside the
`operational conditions of the license, regardless of project size, must be obtained
`from this office. Approvals for such drawdowns will not be given until this
`office has been provided with documentation of coordination with appropriate
`resource agencies. Such documentation should include copies of e-mails, phone
`or meeting records, and letters. All letters to the agencies should be sent
`Certified Mail/Receipt Requested so that copies of said letters and resulting
`receipts can serve as documentation should an agency not respond in writing.
`
`b. Dewatering Tunnels, Conduits, or Penstocks. Under Section 12.4(b), prior
`Commission notification is required for any tunnel, conduit, or penstock
`dewatering.
`
`You must contact this office concerning required approval of these types of
`activities at least 30 days prior to the start of the proposed activity.
`
`Under emergency conditions, immediate dewatering or drawdown may be taken
`without prior approval in order to prevent the loss of the project and to protect
`life and property. In this case, you must notify this office the same day that
`dewatering or drawdown has been implemented, and you must notify the
`appropriate resource agencies.
`
`15. Instrumentation Data and Review. For those projects that have
`instrumentation such as piezometers, inclinometers, horizontal and vertical surveys,
`
`etc., you will monitor the instruments, collect the data, and present the data in
`graphical form with your evaluation in a report and submit the report to this office.
`The report will include your conclusions concerning the performance of the dam and
`its appurtenant works. The information included in this report will be collected,
`presented and evaluated in accordance with Chapter 9 of the Engineering Guidelines.
`You will receive a separate letter from this office concerning any additional details and
`requirements.

`
`1. When you make a submittal by FAX or e-mail, you must still file “hard” copies
`with the Regional Office. All submittals to this office are to be in triplicate.
`
`2. If you are unable to meet an established date for submittal of information or
`completion of necessary project maintenance or construction you must request, in
`writing, an extension of time as soon as you know you are unlikely to complete the
`required activity on schedule. Your letter should include specific reasons for failure to
`meet the agreed upon schedule, your plan to complete the action in a timely manner and a
`proposed date for completion of the item. Submittal of the letter does not grant you the
`requested extension of time. Extensions of time will be granted on a case by case basis
`
`by this office.
`
`3. Excavations for any purpose or advancing of a single bonng/hole constitute an
`exploratory program. These programs should be reviewed by the FERC before you
`proceed. Please allow 30 days for this review.
`
`4. Many are not coding submittals as Critical Energy Infrastructure Information
`(CEII) as you are required to do. You are required to mark on the front page in bold print
`“Contains Critical Energy Infrastructure Information — Do Not Release” on any
`documents that meet the CEII definition. Please refer to our website for more
