`FOR LEAVE TO INTERVENE
`Pursuant to Rule 15(d) of the Federal Rules of Appellate Procedure, Merced
`
`Irrigation District (“MID”) hereby moves for leave to intervene in the above-
`
`

`captioned proceedings in support of Respondent Federal Energy Regulatory
`
`Commission (“Commission” or “FERC”). In support of this motion, MID states as
`
`follows:
`
`I.
`
`In this proceeding, California State Water Resources Control Board
`
`(“SWRCB”) and California Sportfishing Protection Alliance, Friends of the River,
`
`and Sierra Club and its Tehipite Chapter (“CSPA et al.”) filed separate petitions for
`
`review of the following Commission Order(s):
`
`Merced Irrigation District, “Order on Waiver of Water Quality
`Certification,” 171 FERC ¶ 61,240 (June 18, 2020);
`Merced Irrigation District, “Notice of Denial of Rehearings by
`Operation of Law,” 172 FERC ¶ 62,098 (August 20, 2020)
`
`The SWRCB filed its petition for review of the above-referenced June 18
`
`and August 20 Commission Orders on October 2, 2020 in Case No. 20-72958.
`
`CSPA et al. filed their petition for review of the above-referenced June 18 and
`
`August 20 Commission Orders on October 5, 2020 in Case No. 20-72973.
`
`Pursuant to this Court’s October 15, 2020 Orders, the Court consolidated the
`
`above-captioned proceedings. See Case No. 20-72958, Dkt. 6, and Case No. 20-
`
`72973, Dkt. 7.

`II.
`
`MID is a California Irrigation District, organized in 1919 under Division 11
`
`of the California Water Code for the purpose of, among other things, providing
`
`water supply to its customers and operating a water distribution system for a
`
`variety of purposes including irrigation, water storage, municipal supply, flood
`
`control, recreation and hydropower generation. MID is the licensee and owner of
`
`two hydropower projects in the State of California that are at issue in this
`
`proceeding, the Merced River Hydroelectric Project (FERC No. P-2179) and the
`
`Merced Falls Hydroelectric Project (FERC No. P-2467).
`
`III.
`
`On April 8, 1964, the Federal Power Commission (predecessor to the
`
`Federal Energy Regulatory Commission) issued an original 50-year license to MID
`
`for the operation and maintenance of the Merced River Hydroelectric Project.
`
`Merced Irrigation District, 31 F.P.C. 897 (1964). On July 28, 1969, the Federal
`
`Power Commission issued a 45-year license to Pacific Gas & Electric (“PG&E”)
`
`(MID’s predecessor in interest) for the operation and maintenance of the Merced
`
`Falls Hydroelectric Project. Pacific Gas & Electric Co., 42 F.P.C. 237 (1969).
`
`Section 401(a)(1) of the Clean Water Act (“CWA”) requires that an
`
`applicant for a federal license or permit to conduct activities that may result in a
`
`discharge into the navigable waters of the United States must provide the licensing
`
`
`

`or permitting agency a water quality certification from the state in which the
`
`discharge originates or evidence of waiver thereof. 33 U.S.C. § 1341. If the state
`
`“fails or refuses to act on a request for certification, within a reasonable period of
`
`time (which shall not exceed one year) after receipt of such request,” then
`
`certification is waived. Id. § 1341(a)(1).
`
`PG&E filed an application for water quality certification for relicensing of
`
`the Merced Falls Hydroelectric Project with the SWRCB on May 20, 2014. On
`
`May 6, 2015 and on May 4, 2016, PG&E withdrew and resubmitted its application,
`
`as expected and encouraged by the SWRCB. On March 3, 2017, FERC assigned
`
`the Merced Falls Project license to MID. Subsequent to that assignment, MID, as
`
`the licensee, withdrew and resubmitted the application for the Merced Falls
`
`Hydroelectric Project, as directed by the SWRCB, on May 1, 2017 and April 24,
`
`2018.
`
`MID filed an application for water quality certification for relicensing of the
`
`Merced River Hydroelectric Project on May 21, 2014. On May 14, 2015, May 9,
`
`2016, May 1, 2017 and April 24, 2018, MID subsequently withdrew and
`
`resubmitted its application, as requested and encouraged by the SWRCB. With
`
`each resubmittal, MID noted that the “Project has not changed” and that the FERC
`
`application that the SWRCB had on file contained all information required for a
`
`complete application for certification.

`On January 25, 2019, the United States Court of Appeals for the District of
`
`Columbia Circuit issued an opinion in Hoopa Valley Tribe v. FERC, holding that,
`
`where an applicant repeatedly withdraws and refiles the same water quality
`
`certification application for purposes of allowing the state to avoid the one-year
`
`deadline, the state has waived certification. Hoopa Valley Tribe v. FERC, 913
`
`F.3d 1099, 1101 (D.C. Cir. 2019), reh’g denied, No. 14-1271, 2019 WL 3928669
`
`(D.C. Cir. Apr. 26, 2019) [“withdrawal-and-resubmission of water quality
`
`certification requests does not trigger new statutory periods of review”], cert.
`
`denied sub nom. Cal. Trout v. Hoopa Valley Tribe, 140 S. Ct. 650 (2019).
`
`On April 22, 2019, the SWRCB denied without prejudice MID’s requests for
`
`water quality certification for the Merced Falls Hydroelectric Project and the
`
`Merced River Hydroelectric Project.
`
`On May 22, 2019, MID submitted to FERC a notice of denial of water
`
`quality certifications and request for clarification of whether the SWRCB waived
`
`its authority under Section 401(a)(1) of the CWA to issue a water quality
`
`certification regarding the relicensing of the Merced Falls Hydroelectric Project
`
`and Merced River Hydroelectric Project. On June 27, 2019, the SWRCB
`
`submitted a response to MID’s request, asking that the Commission find that
`
`SWRCB did not waive its water quality certification authority. On June 28, 2019,
`
`American Rivers, American Whitewater, California Sportfishing Protection
`
`
`

`Alliance, Friends of the River, Golden West Women Flyfishers, Merced River
`
`Conservation Committee, Northern California Council Fly Fishers International,
`
`and Trout Unlimited filed responses to Merced’s request, also asking that the
`
`Commission find that SWRCB did not waive its water quality certification
`
`authority.
`
`On June 18, 2020, the Commission issued an “Order on Waiver of Water
`
`Quality Certification,” finding that the SWRCB waived its authority under Section
`
`401 of the CWA to issue a water quality certification for the relicensing. The
`
`SWRCB and various conservation groups, including California Sportfishing
`
`Protection Alliance, Trout Unlimited, American Rivers, American Whitewater,
`
`Merced River Conservation Committee, Friends of the River, Golden West
`
`Women Flyfishers, Northern California Council of Fly Fishers International, and
`
`the Sierra Club Tehipite Chapter filed Requests for Rehearing of FERC’s Waiver
`
`of Water Quality Determination on July 20, 2020 and July 17, 2020, respectively.
`
`On August 20, 2020, FERC issued a Notice of Denial of Rehearings by Operation
`
`of Law.
`
`On October 2, 2020, the SWRCB filed its Petition for Review of FERC’s
`
`Orders, and on October 5, 2020 CSPA et al. filed their Petition for Review of
`
`FERC’s Orders with this Court. As the owner and licensee for both the Merced
`
`
`

`Falls Hydroelectric Project and the Merced River Hydroelectric Project, MID
`
`requests to intervene in support of FERC’s decisions.
`
`IV.
`
`As the owner and licensee of the Merced Falls Hydroelectric Project and the
`
`Merced River Project, MID, which fully participated in the Commission’s
`
`administrative proceedings below, will be directly affected by the outcome of this
`
`case and, therefore, has a substantial and direct interest in this proceeding that
`
`cannot be adequately represented by any other party.
`
`As noted by the Seventh Circuit, persons such as licensees or permittees,
`
`whose legal interests are directly at stake are appropriate intervenors. Sierra Club,
`
`Inc. v. Environmental Protection Agency, 358 F.3d 516, 518 (7th Cir. 2004)
`
`(admitting the permittee seeking to construct a coal-fired power plant). As to the
`
`issue of adequate legal representation, the court went on to note that while an
`
`agency will normally “stick up” for its actions in response to a petition for review,
`
`if it loses, the Solicitor General may decide not to pursue the matter further to the
`
`Supreme Court. (Id.). “Intervention by the original victor places the adversaries on
`
`equal terms and permits both to make their own decisions about the wisdom of
`
`carrying the battle forward.” (Id.)

`MID is the “original victor” in this proceeding, and accordingly, it is both
`
`appropriate and in the public interest that MID be permitted to intervene in this
`
`proceeding to ensure that it can participate fully and in all respects.
`
`V.
`
`WHEREFORE, MID respectfully moves that it be granted leave to intervene
`
`with rights to participate fully in all aspects of this proceeding.
