`12 of the FERC Regulations. At a later date, you will receive a

`(HLCTS) for your projects. That printout could be compared to your
`records.

`be complete and certain requirements may not be applicable to all
`projects. Therefore, each Licenseeand Exemptee must be familiar
`with their specific license or exemption requirements and the
`requirements contained in 18 CFR Part 12. You should periodically
`review the license/exemption and the current regulations to ensure
`timely compliance with all requirements since Licensees/Exemptees
`have
`continuing responsibilities, such as consultation and proof
`of service.

`least 10 days
`in advance of plans to remove any
`public safety device.
`For those devices routinely
`removed annually, a one-time notification providing
`the reason amd schedule for periodic removal and
`reinstallation is acceptable.
`
`In accordance with Sectipn 12.10 (b), any drowning or
`accident
`resulting in death or/’serious injury to the
`public or construction and maintenance workers at
`a
`project must be reported to this office.
`If project
`related,
`the initial
`report
`should be by telephone
`promptly upon becoming aware of such an incident.
`The
`telephone report should be followed by a written report
`that
`fully describes
`the incident
`and any remedial
`actions taken or proposed to avoid or reduce the chance
`of
`future similar occurrences.
`If you believe that
`remedial actions are unnecessary,
`the report
`should
`explain why.
`If the accident was not project related,
`the
`subsequent written report may
`be
`conveyed
`by
`providing a copy of a newspaper article.
`
`- If your project requires an
`Emergency Action Plan (EAP)
`FAP, on January 5, 1999, you were sent a copy of
`the
`revised
`EAP Guidelines, Chapter VI
`of
`the
`FERC
`Engineering Guidelines. Unless you received an extension
`of time,
`the complete reprinting of your EAP under the
`revised guidelines was due by December 31, 1999.
`If you
`have complied, disregard this item. Regarding the annual
`review of your plan, which should have been incorporated
`into your preparation of the reprinted EAP,
`the following
`conditions are required by Subpart C of 18 CFR 12 of the
`regulations:
`

`
`Ensure that an up-to-date EAP notification list is
`posted in a prominent location at each development,
`readily
`accessible
`to
`operating
`personnel
`responsible for notification. The EAP Notification
`Flowchart
`and other appropriate sections should
`indicate the primary and secondary FERC contact,
`which are the Regional Director and the Branch
`Chiefs, respectively.

`Pursuant to Section 12.4 and Standard Articles 14 and/or

`preventing soil erosion, sedimentation, and any form of
`water or air pollution. Release of hazardous liquids
`(oils, grease, etc.) is under the jurisdiction of state
`water quality agencies and the EPA,
`and the project
`operators should be aware of the requirements of those
`agencies.
`Other potential
`sources
`of
`hazardous
`materials,
`in addition to those sources directly related
`to the project
`(transformer, governor, and lubricating
`Oils),
`include public marinas and private boat docks.
`While
`Licensees/Exemptees
`may
`not
`have
`direct
`responsibility for the operation of such facilities, you
`should assist or otherwise facilitate in Minimizing the
`introduction of pollutants into project waters and advise
`such operators to promptly report spill
`incidents to
`appropriate state and Federal agencies and this office.
