`WBI Energy Transmission, Inc. (WBI Energy), hereby requests approval from the Federal
`Energy Regulatory Commission (Commission or FERC) to initiate the Commission’s National
`Environmental Policy Act (NEPA) pre-filing review process for its planned Bakken East Pipeline
`Project (Project). This request is submitted in accordance with 18 C.F.R. § 157.21(b) of the
`Commission’s regulations. Upon completion of the pre -filing review, WBI Energy will file an
`application with the Commission for authorization to construct and operate the Project under
`Section 7(c) of the Natural Gas Act (NGA). WBI Energy is evaluating using the expediated review
`under NEPA for the Project consistent with the opt -in fee process and schedule established
`pursuant to Section 60026 of the One Big Beautiful Bill Act.
`Pursuant to 18 C.F.R. § 157.21(c), representatives of WBI Energy met with Commission
`Staff on December 4, 2025, to review the Project and WBI Energy’s progress towards obtaining
`the information required for use of the pre-filing process.
`The Project is being planned to serve new power generation, industrial facilities, and local
`distribution company demand in central and eastern North Dakota based on the results of a non-
`binding open season held in late 2024/early 2025. The Project will interconnect with WBI
`Energy’s existing natural gas pipeline system and other interstate pipelines along the planned route
`serving the Midwestern United State s. The initial design of the Project includes approximately
`350 miles of mainline pipeline and approximately 90 miles of lateral pipelines, new and modified
`compression, and various measurement and interconnect facilities in North Dakota. WBI Energy
`intends to hold a binding open season in the first quarter of 2026 after which final facility design
`will be determined. It is anticipated the Project will be constructed over two construction seasons
`and will be placed in service in two phases. The first phase of the Project has a target in -service
`date of November 2029, and the second phase has a target in-service date of November 2030.

`following information regarding the Project to initiate the pre-filing process:
`

`2. Zoning and Availability (18 C.F.R. § 157.21(d)(2))
`Not applicable. The Project does not involve a liquefied natural gas (LNG) facility.
`3. Request Use of the Pre-filing Process (18 C.F.R. § 157.21(d)(3))
`WBI Energy is requesting to use the pre -filing process to allow agencies, affected
`landowners, and other stakeholders to work cooperatively with WBI Energy and Commission staff
`to identify and address environmental issues prior to the filing of the Certificate application. The
`open and proactive communication associated with the pre-filing process will allow WBI Energy
`to prepare a Certificate application that more accurately and adequately address es stakeholder
`concerns. Early stakeholder engagement is consistent with WBI Energy’s commitment to building
`and maintaining strong relationships with the communities in which it operates.
`4. Project Description (18 C.F.R. § 157.21(d)(4))
`The current design of the Project consists of approximately 350 miles of new mainline
`pipeline consisting of 36 or 42-inch pipeline from WBI Energy’s existing Elkhorn Creek
`Compressor Station to central North Dakota and 24, 30, and/or 36-inch diameter pipeline from
`central North Dakota to its existing Mapleton Compressor Station. C ertain natural gas lateral
`pipelines from processing plants within the Bakken region, as well as an approximate 9-mile-long
`8-inch-diameter lateral pipeline in Barnes County and an approximate 82-mile-long 20-inch-
`diameter lateral pipeline in Barnes, Lamoure , and Dickey Counties are included in the current
`design. Additional lateral pipelines may be included after the binding open season. Potential
`compression includes the construction of two greenfield compressor stations and additional
`

`compression at three existing compressor stations . V arious measurement and interconnec t
`facilities would also be constructed. An overview map is attached as Exhibit A.
`
`Design and engineering for the Project are ongoing; therefore, plot plans for compressor
`stations and various measurement and interconnect stations are not available at this time. WBI
`Energy anticipates filing plot plans for these facilities with the Certificate application.
`
`5. List of Relevant Federal and State Agencies in the Project Area with Permitting
`Requirements (18 C.F.R. § 157.21(d)(5)).
`Exhibit B contains a table listing relevant federal and state agencies with regulatory review
`or permitting authority over the Project including address and contact information. Exhibit B also
`lists Indian Tribes that have or may have an interest in the Project. The table identifies the permit
`or approval required from each agency ; verifies that each agency has been contacted by WBI
`Energy; and indicates if the agency is expected to participate in the pre-filing process. WBI Energy
`plans to file all major federal permits concurrently with the Certificate application.
`WBI Energy sent introductory Project outreach to the U.S. Army Corp of Engineers
`(USACE) and U.S. Fish and Wildlife Service (FWS) in March 2025 followed by meetings and
`discussions to gather information on resources in the Project area. Additionally, outreach letters
`providing information about the Project were sent to Indian Tribes in April 2025. The letters to
`the Indian Tribes noted that the Project is subject to review under section 106 of the National
`Historic Preservation Act, FERC is responsible for government -to-government consultation, and
`that archaeological surveys would begin along the planned pipeline route in the summer of 2025.
`WBI Energy also solicited the Indian Tribes’ participation in the archaeological field surveys.
`Project introduction letters were mailed to all agencies listed in Exhibit B by October 30,
`2025. As a follow -up to the Project introduct ory letters, WBI Energy has started contacting the
`agencies to determine their interest in participating in the pre -filing process and will continue to
`communicate with them throughout the Project.
`6. List and Description of the Interest of Other Persons/Organizations Contacts about
`the Project (18 C.F.R. § 157.21 (d) (6)).
`Exhibit C contains a table listing federal, state, and local officials, and other interested
`parties identified by WBI Energy. These stakeholders are in addition to the agencies in Exhibit B.
`The table provides address and contact information for each stakeholder. WBI Energy will send
`Project introductory letters to these stakeholders prior to public open houses . A Public
`Participation Plan has also been developed to identify and inform stakeholders who may be
`affected or have an interest in the Project. The Public Participation Plan is provided in Exhibit D.
`7. Project Work Already Done (18 C.F.R. § 157.21(d)(7))
`Stakeholder Engagement: WBI Energy has identified the stakeholders listed in Exhibits
`B and C. WBI Energy has engaged with t he agencies and Indian Tribes listed in Exhibit B as
`explained above and the stakeholders listed in Exhibit C will be notified prior to the public open

`houses. WBI Energy will follow up with these stakeholders in the upcoming weeks. WBI Energy
`has also prepared a Public Participation Plan for the Project (see Exhibit D).
`Agency Engagement: In April 2025, the FWS provided Geographic Information System
`(GIS) data for various FWS easements (e.g., grassland, wetland, waterfowl production areas) in
`the Audubon, Chase Lake, Long Lake, and Valley City Wetland Management District s.
`Preliminary discussions with the U.S. Forest Service (USFS), Bureau of Reclamation, and the
`Bureau of Land Management (BLM) regarding surveys on federal lands took place between April
`and September 2025. WBI Energy will schedule an interagency call in early 2026 between the
`USACE, USFS, and BLM to discuss BLM involvement and issuance of a right-of-way easement.
`Additional activities conducted to date to engage regulatory agencies are described in Section 5
`above. Information regarding agency engagement is also provided in Exhibit B.
`Tribal Engagement : In response to the April 2025 outreach letter and subsequent
`communications, the following twelve Indian Tribes expressed interest in participating in cultural
`surveys for the Project: Crow Tribe of Montana; Flandreau Santee Sioux Tribe of South Dakota;
`Fort Belknap Indian Community; Northern Cheyenne Tribe; Rosebud Sioux Tribe; Sisseton-
`Wahpeton Oyate of the Lake Traverse Reservation; Spirit Lake Tribe; Standing Rock Sioux Tribe;
`Three Affiliated Tribes of the Fort Berthold Reservation (MHA Nation); Turtle Mountain Band of
`Chippewa Indians; Upper Sioux Community; and Yankton Sioux Tribe of South Dakota. WBI
`Energy held a virtual meeting with interested Indian Tribes on September 18, 2025, to discuss the
`Project, tribal participation, and the cultural survey methodology. Tribal participation in cultural
`surveys began on September 23, 2025.
`Land/Right-of-Way: WBI Energy has identified landowners along the planned route
`through publicly available data and courthouse research in each of the counties crossed by planned
`Project facilities. WBI Energy began contacting landowners in January 2025 and held invitational
`landowner information meetings in Watford City, Killdeer, and Beulah , North Dakota on
`November 3, 4, and 5, 2025, respectively and Bismarck, Ellendale, Jamestown, and Casselton,
`North Dakota on November 17, 18, 19, and 20, 2025, respectively. A list of affected landowners
`will be included with the stakeholder mailing list to be filed with the Commission staff within 30
`days of receiving Commission approval to use the pre-filing process in accordance with §157.21
`(f)(4).
`Route and Facility Planning: WBI Energy evaluated a number of potential routes and
`facility alternatives for the Project. For the route as currently planned, WBI Energy completed a
`detailed review of publicly available data, aerial photography, topographic maps, and ground
`reconnaissance to identify routing constraints and opportunities . Based on environmental and
`engineering considerations, existing corridor collocations, and landowner discussions, WBI
`Energy selected the planned pipeline route and facilities that have been used to initiate discussions
`with stakeholders. As WBI Energy continues engagement with landowners and other
`stakeholders, WBI Energy will continue to refine the route and planned facilities. Environmental
`and cultural survey results will help determine if additional route adjustments are needed.
`Open Houses: WBI Energy plans to hold open houses along the planned route in February
`2026 upon consultation with FERC staff. Additional information on WBI Energy’s open house s
`is provided in the Public Participation Plan provided in Exhibit D. WBI Energy held invitational

`landowner information meetings in November 2025 as described in the Land/Right-of-Way
`section above.
`Engineering and Environmental Subcontractors : WBI Energy is engineering the
`Project, conducting centerline and civil surveys, and will prepare aerial photo- based alignment
`sheets for the Project. WBI Energy has contracted with Burns and McDonne ll Engineering
`Company, Inc. (Burns and McDonnell) to provide engineering, environmental, and permitting
`support services, environmental field surveys, and to support stakeholder engagement activities.
`Biological Field Surveys : WBI Energy consulted FWS’s Information for Planning and
`Consultation (IPaC) system to identify federally listed threatened and endangered species in the
`counties crossed by the Project. Based on IPaC results and conversations with the FWS, USFS,
`and BLM, WBI Energy determined that sensitive species habitat surveys would be required for
`the Dakota skipper and the western regal fritillary in select locations across the Project route. WBI
`Energy will hold conference calls with thes e agencies in December 2025 to discuss appropriate
`field surveys and survey protocols . WBI Energy conducted wetland, waterbody, general habitat
`field surveys, and sensitive species habitat surveys beginning in June 2025. Additional s urveys
`will be conducted in the summer of 2026 or in accordance with survey windows identified by the
`agencies.
`Cultural Resources Field Surveys: On several occasions between February and August
`2025, WBI Energy conducted research at the State Historical Society of North Dakota to identify
`previously recorded cultural resource sites along and near the planned Project facilities.
`Additionally, WBI Energy has initiated correspondence with the North Dakota State Historic
`Preservation Office to discuss field methods for cultural resources field surveys. WBI Energy
`prepared a scope of work for the field surveys which was approved by the State Historical Society
`of North Dakota and field surveys began in June 2025. In September 2025, WBI Energy submitted
`an Archaeological Resources Protection Act (ARPA) cultural resources permit application to the
`district archaeologist at USFS, Dakota Prairie Grasslands, and a fieldwork authorization request
`to BLM, North Dakota Field Office. The Grasslands ARPA permit and BLM fieldwork
`authorization request were approved by the agencies in September 2025.
`8. Third-Party Consultant Proposals (18 C.F.R. § 157.21(d)(9))
`WBI Energy plans to hire and fund a third- party environmental consultant to prepare the
`NEPA document for the Project. WBI Energy submitted a draft Request for Third-Party Proposal
`for FERC staff’s review in December 2025 and will begin soliciting proposals from potential third-
`party contractors in December 2025. WBI Energy will submit the third-party contractor proposals
`to FERC in January 2026 and anticipates FERC will select a third-party contractor prior to FERC’s
`initiation of scoping, which WBI Energy anticipates will begin in March 2026.
`9. Acknowledgment: Complete Environmental Report and Complete Application
